Want to cancel RBM contract.

Okay, just want to post about my RBM contract I would like to cancel and hear what you guys think about it.

In June 2011 I started my RBM contract (RBM 200 with the RBM HD/Hauwei U8800), used the phone for about a few months, then had to give it in for repair because of the screen. I received a new phone about 3 weeks later. That phone lasted a few month until it had problems charging, 3 weeks later they gave me yet another new phone (Still the Hauwei U8800) and now after a few weeks this one is giving problems, not charging properly, no 3G signal, battery only lasting a half day without using it. Now I would like to cancel the contract because Cell C keeps giving me faulty hardware and I don't want to send it in for repair again because then I would be without a phone for about 3 weeks. Not really an option because I receive many email a day and have to respond quickly. I have spoken to Cell C here on MyBroadband and he has help me a lot. I ask what the cancellation fee would be and it is R2081.16. This sounds really high for a cancellation fee. To me understanding the CPA states that the cancellation fee must be reasonable and I also read about it not being more than 10% of the remainder of the contract. Please correct me if I'm wrong.

Any advice from you guys about what I should do? Thanks.

EDIT: I still want to stay at Cell C and get The Galaxy Nexus on straight up 100 (Reason for canceling contract and not just getting my phone replace. )

That's the worst phone on the Rbm deals. Maybe ask if cell c rep can assist with an early upgrade?

the 10% is for the contract fee.. ie.. connection / free megs / minutes / sms... not for the handset subsidy. besides being crappy - they still gave you a handset with a value of about R3500k...

Indeed, maybe should have gone with the Motorola Defy:(. Called Cell C again and was told about the early upgrade. Will be going to Cellc centurion tomorrow to sort things out.

9 months of the contract left. 9 X 249 = R2241. 10% of R2241 = R224.10, Which is more than payable. As for the handset, why should I pay for faulty hardware. Then again, I still used the phone.
