Bad move by the courts, this undermine their authority. And !casa's authority as well.

If the grounds for an interim interdict were present the court was right to grant the order. Unfortunately the full factual matrix is not in front of us but what is clear is:
(A) ICASA has a claim of several million rand in licence fees and penalties against WBS. The validity of this claim is not perfectly clear in part because of the problems with the change of spectrum licence fees. I suspect that depending on the validity of the changes etc ... that all of the major operators bills could change by a great deal - if I am not mistaken the old calculation system would benefit Telkom whereas the new one would benefit Vodacom and MTN - and that it is sensible to only be aggressive in enforcing the lowest charge that would be applicable to each player.

(B) WBS has installed microwave links which are operational and unlicensed. The refusal to license the links appears to stem from the unsettled claim on license fees.

(C) If there is a dispute about money owed ICASA would be better placed to not disrupt services and rather attach WBS's debtors book and so forth. If there is a situation of WBS operating illegally and there being a flagrant disregard for the law ICASA needs to enforce the law.

Sadly ICASA is in a generally precarious position and so the urge to go cowboy probably exists far more than it should. My guess is that WBS could establish grounds for an interim interdict on the basis that ICASA's conduct would cause irreparable harm.
