What to do if Rear Ended?

So yesterday Afternoon in Cape Town CBD I got rear ended while in traffic, at first glance the only damage that I could see was what appeared to be a cracked bumper on my car, but after later inspection I found it was just the paint that had been cracked, but the sides of the bumper had come loose and it appears as if the clips may have slightly been damaged. The other car had no damage, other than a cracked number plate.

My question is what is the procedure to get this fixed and claiming?
Do I still report it at the police station?
Do I get my insurance to fix it and let them claim from the other driver or do I claim direct from the other driver?
Not sure on the complete process here so any help/advice would be appreciated.
 
Good link, also if you want to claim from insurance you'll need a case number.

@Joker: thanks, I just spent the last 2 hours at CT police station just fill out the Accident Report form and get a case number...So wish there was an easier way.
 
Always report the accident as soon as possible.

You get funny people in this world.
He might just open a case against you to say you rolled back into him to avoid the claim.

Does not matter if its a small fender bender rather report the accident and forget about it, but at least it is on record.

And yes you do need a case number for a claim.

You go to your insurance generally. The other driving, even if not disputing the facts, is under no obligation to pay you a thing unless so ordered by a court in a judgement. To get there, you'll need to take legal action. Your insurance will always determine the benefits and then take the necessary steps to either recuperate their loss or write them off.

It is the other(back) person's responsibility to ensure that they leave enough space infront of them, else if your vehicle rolls back slightly, it is their fault. (does not apply when reversing, only applies where both vehicles intended travel direction if "forward facing".

The post you quoted refers to physically moving forward/being in motion already or illegal parking. OP mentions slow moving traffic (stop/start) CBD traffic.).

Those are just some scenarios - the point being assuming the person he hit you from behind is to blame can be a dangerous practice. Rather, make use of your insurance and let them make determinations.
