Windows 8 = disaster

I've had it for a while now on my personal laptop and to be honest, I miss it when on my work laptop running Windows 7.

I basically live in Modern UI mode and only have to go to desktop for 3G connections, Office (I believe with 2013, I won't have to anymore), and managing files.

Ubuntu's walled garden will be no better than Apple's - it will most definitely be a lot worse. Being an "official" anything in China ....
Ubuntu defaults to sticking with their tested packages and versions, but in no way prevents you from installing whatever you want. Much like Apple's OS X.

I installed W8 on my 3 year old HP laptop last year in October. The only thing I had to do was to download W8 drivers for our network Ricoh multifunctional printer.
Not a single issue. Works flawlessly.

I was used to the UI on the first day of use.
