Windscreen damaged at car wash

Left my car being washed at a car wash and when i came back 2 hours later, the wiper was off the wiper blade and the blade was on my windscreen with multiple cracks. They have initially denied reaponsibility citing the disclaimer on their wall which says they are not responsible for loss/damage. After viewing their cctv again, they have called me and "apologised" and said they will claim from their insurance. I know i am going to be sent pillar to post, any advice ?
 
They called and apologised, and are submitting the claim...

What more do you want ?

You can claim from your own insurance and claim the excess back from them if you want to take a different route.
 
What he said. Just claim from your own insurance if an issue, they will pay.

Leaving the car at a business pressed for time is a risk, these things do happen.
 
I'm pretty sure every car wash i've been to has a notice board that says if you wash your car there they take NO responsibility for damage of any kind.

I don't think negligence can he excluded, there has to be some responsibility on their part despite them claiming otherwise.

Only valid for anything that happens which is out of their control. Those notices are worth nothing where any negligence is involved.
 
You cannot contract out of liability in this manner.
Get a quote from a good approved panel beater and submit it to the car wash.
Make sure that the panel beater is approved for your vehicle.
Take clear pictures of the damage for this claim and for the day you want to sell the vehicle.

Why is an approved panel beater required? Rather than an automotive glass place?
 
Get a copy of the Cctv footage ASAP. They may deny later.

Get admission of guilt in an email or some kind of writing. Rest will then be easy.

Why would they give you a copy of the CCTV footage, especially if you think they're going to deny it later? :confused:
