Makes me believe that there is more to this story, like he overstepped an instruction regarding the case.

Well, he was probably instructed to commit a criminal offence, ie to obstruct justice.

He did the right thing by not following that instruction - not too good for his career, though.

Yeah but even in companies insubordination is a dismissable offence. You refuse to do something your boss tell's you to do, prepare for the hurt.

I agree he needs support but you have to wonder why the likes of the opposition party aren't getting involved.

They may be holding-off because their involvement might mean the ‘kiss of death’ and give the ANC an excuse for political thuggery.

Break the law how? As far as we know, the chief could have asked the officers not to further involve themselves on the case. I'm really just throwing this out as reasons why the DA etc have been so quite on the matter.

That was the Nazi’s defence – “we were only following orders.” There is a generally accepted mitigation for insubordination when it goes against the mission statement of the organisation (fight crime, one law for all, etc.) – like this.

Police on Monday suspended warrant officer Jannie Odendaal after he opened criminal cases against Winnie Madikizela-Mandela and her two bodyguards.

The warrant officer opened cases of obstruction of justice and assault against the three on Sunday, following an altercation in December. Odendaal and another officer allegedly stopped Madikizela-Mandela’s car for speeding on the highway.

Trade union Solidarity’s Dirk Hermann said Odendaal was being victimised for standing up to the political elite.

“He just did his work,” said Hermann. “Nobody actually in the whole police force at this stage stands with him from the administration side.”

He added that Odendaal’s letter of suspension did not specify the reason for the suspension. The letter, which came into effect on Monday, said the charges could result in his dismissal.

Hermann added that Odendaal was disappointed, but he was going to fight the matter.

The police could not be reached for comment.

1. The employer MUST MUST MUST give reasons for suspending an employee! They just made his life so much easier as far as legal action from his side is concerned ;)

2. "The police could not be reached for comment." Huh??? It's the police; they ought to be available 24/7.
 
Seems to me that everyone thinks Winnie is a politition. She is just the former wife of the former President! Why does she get all this protection and transport from the tax-payer anyway? Same goes for Jules Mal - the ANC, not the tax-payer, should be paying for these arseholes to be transported about.
 
I have lots of respect for people that will do the right thing when confronted with a situation like this.

The easy way would have been to apologize to Winnie, what he's doing (if his side of the story is legit) is something we should all aspire to do in situations like these.
 
Two more quick things:

1. As far as insubordination is concerned, an employee is only expected to obey lawful instructions from the employer. In other words, if my employer instructs me to commit a crime, and I do not obey, I cannot be charged with insubordination (it will not be upheld in a court or any other tribunal).

Ummm ... I know it's hard to keep up with politics, but Winnie IS a politician. She is an MP ;)

Yes but that's all speculation at this point, it could be that his employers told him to keep his mouth shut and he didn't.

That's probably why he is only suspended and not dismissed yet. He will now have to go through a DC hearing whereby facts will be put on the table and if found guilty he might be dismissed. If not he can lay a counter charge for victimisation.

I was merely giving the legal position as far as the offence of insubordination is concerned :)

it is a very good idea to dismiss people who did their job but remain criminals are running SAPS.
