Wrongful arrest claims - is it worth it?

I would personally sue the police officer himself, not the SAPS. Go after that one individual, just prove they know each other etc. The only problem is these police are normally savages and will now harass you 24/7, it could get ugly.

I'm a different cloth, I would just go after them at a much later date with my two friends at long range, their names are Lapua and Magnum, they always travel together.

Remember the lawyers always win
 
I had a similar event, although not arrested. I sold a cellphone via FB and got scammed. The dude paid me in CASH but counterfeit money. It was really well done and I only realised it was fake once I got home.
I did spend some of it at a garage refueling my car. The attendant didnt realise it was fake.
When I got home, I noticed that the serial numbers are the same on multiple bills. Took the remaining cash to our local SAPS and opened a case. I informed them I used some of it at station X.
Next day while I am at work, a cop from the dog unit rocks up at my house and starts threatening my wife saying he will arrest me Infront of my child. My wife gave him my number and turns out he is friends with the garage owner and used his resources as a cop to get my info.
I told him to go fly a kite and to comeback with a warrant as I have a SAPS case and if he did some actual police work he would have noticed that.

You really covered yourself well there, 'cop' must have felt like a total moron (hopefully).

That sucks, I've wondered about that before, when you sell something you count the notes but that's it, did the notes have watermarks and all the other security features intact?

In a detailed breakdown, Mchunu revealed that there were 3 303 claims filed against the state for wrongful arrest and detention in the 2020/2021 financial year, with Saps paying out R239.2 million (R239 299 759.27).

The following year saw an increase to 3 830 claims during the 2021/2022 period, with payouts rising to R346.2 million (R346 220 870.81).

Also, how did you "engage" the defendant's ex legal counsel? I presume you mean that they agreed to testify, rather than that you engaged their services?

I had been given the nod to install a temperature monitoring system at the new build of Groote Schuur Hospital and entered into agreement with an Austrian supplier to purchase their products over the 2 year contract period.

When the contract fell apart, certain unrecoverable costs were incurred

This, plus the infrastructure I had already installed was taken into account by the court

My own attorney called the fired attorney and explained how they would proceed. He received R8000 for his evidence . He realised the fellow was dishonest and also technically inept. His plan of work had several major flaws

In the end a Japanese contractor did the work. It was 80% over budget

Yes they had all the security features. Cops even said these are amazing fakes, only thing that gave it away was the serials all the same

Go for it.... The bar for wrongful arrests claims is extremely low I've never heard of a case were SAPS has won a case, the will usually settle but it might take years depending on the quantum amounts. My advise is too go for R200k nothing to huge that will initiate high court proceedings and is something SAPS would just quickly pay out. It is not a much of a lengthy exercise, you could be done in less than a year, if you go to the High Court it could take 8 years.

Also, go to the police station where the police member is attached and lay an complaint, they will usually have a designated officer (in station /district) to have a look at the police member's conduct, some of them can be very eager, maybe the matter will end up at Disciplinary Management which is a unit in SAPS. Once he's at that unit and the matter is on his record it might tarnish any opportunity he has of going up the ranks.
 
Communication between SAPS branches is so poor that even if an individual cop or station commander was successfully prosecuted in court, the general staff will not hear about it

Thus "teaching the SAPS a lesson" will not materialise
