You CAN sue Eskom

Actually come to think of it the public should stop paying tax until the *****s running the country pull finger and actually do their elected job by managing the country correctly and actively sorting out things like the electricity crisis and the rampant crime.

I highly doubt such a case against eskom will be successful.

The government already apologied for not aproving eskom's plans for new power stations which were presented to them many years ago.

I don't know exactly what eskom tried to do to prevent the load shedding or if it was enough, but I think as long as they can shift the blame to the governement eksom will be in the clear. If they can do that then the case of breach of contract will not be successful due to force majeure. The claim for damages because of them contravening the act could possibly also be avoided on a similar basis.

And most importantly, any significant action for damages against eksom will fail if eskom can prove that all available funds would be needed to return SA's power production back to normal as quickly as possible, because it is against public interest.
 
There's *no* way that that is going to work. Its just not feasible to allow more or less all the companies in SA to sue Eskom. One could perhaps sue for damaged electrical equipment, but not for business downtime/92kg of cookies.

Also, I seem to recall that parastals get all kind of legal rights etc that normal companies don't.

sox63: You would need to sue the company itself, not the CEO first. Only if the company fails to pay, then you can go after the directors. Thats assuming you can prove gross negligence an managements part which you won't be able to do after Mbeki's apology.
