Zuma files second affidavit on state capture

President Zuma filed a second affidavit on Tuesday, asking Public Protector Busisiwe Mkhwebane to confirm whether the state capture report compiled by her predecessor, advocate Thuli Madonsela, is final.

Zuma has also confirmed he was formally notified that he's an implicated person in the report on October 2.

Mkhwebane has said she was open to including the president’s input in the report, pending the outcome of upcoming court proceedings.

A few weeks ago, the president filed an interdict, preventing Madonsela from releasing the report before she left office.

Zuma claimed he had not been given the opportunity to respond to Madonsela's questions.

I'm sure that part of the condition for the interdict was that the report would be released "unaltered" if rejected. Looks like he wants her to modify it.
 
In a way it is nice to Madonsela's plan in action. We as the public get to see if we have a public or puppet protector.
 
Typical Zuma stalling tactics, not the response of a man 'looking forward' to his day in court as he usually tries to claim. That said, there is quite possibly shoddy work from the former PP and quite possibly poor legal procedures on her part which have all played into Zuma's hands.

Zuma will just copy Hillary Clinton if it gets leaked to Wikileaks. She just says she won't comment on something that was obtained illegalyl. Did you see how she pivoted in the 3rd presidential debate when asked the question. She just refuses to answer. She knows any information she might give will incriminate her.
 

Madonsela is correct in saying this. The new PP never had insight to the investigation. She never discussed it with the old PP who started it. So, how could she oppose the application in court with virtually no insight into the matter. I too would not have opposed it until I was brought up to date.

But, take a look at what Madonsela said - the new PP never spoke to her the first day, she rather spoke to employees. The new PP never had the scheduled meeting, but rather postponed it.

It is clear the new PP is in Zuma's pocket.

I have no doubt that within the next few months the new PP will issue a report that she conducted her own investigation and that there were no evidence of state capture. She will probably make Madonsela's report as an incomplete investigation, which never took into consideration all relevant facts and that her report would have concluded the same if she had more time to complete her investigation properly. The whole matter will be closed and then it will be up to political parties to take the matter to courts again.

You can already see this whole matter is leaning in that direction - both Zuma and van Rooyen saying they had no opportunity to answer her. This will be the only reason why Madonsela's report will be considered incomplete and why courts will side with Zuma. I just think Madonsela did not have enough time to complete her investigation 100% and nail these f***ers.

Not really. He was given the questions in March and had more than enough time to respond. It seems like he had plenty of time to interdict this report and go dancing in Kenya, but conveniently not enough time to answer the questions...

As I said we know these are stalling tactics BUT it appears that the former PP listed him as a 'primary subject' instead of an 'implicated person'. Same thing to you and me, but in a court of law? Only court decisions and time will tell if shoddy legal work is allowing his legal team to find loopholes to enable these delay tactics.

Notified by whom? Does he have insiders at the PP? The PP is supposed to be independent.

Probably by Thuli. She said she approached him for an interview to answer questions. She is obliged to inform him that he is implied and that she is conducting an investigation against him. Much like the police when investigating a criminal case, he has to be informed of the investigation and made aware of his rights.

If I were implicated in an investigation and I was innocent, I would work really hard at answering the questions in order to clear my name.

If I were implicated in an investigation and I was NOT innocent, I would work really hard at buying time, subverting and obfuscating in order to save myself.

Problem is Zuma actually believes Putin is his friend, he can't just quickly leverage decades of cold war propaganda and claim anything published by WikiLeaks is the ill gotten gains of Russian hackers without offering a shred of evidence ... :whistle:
 
Remind me again, why did Madonsela leave the release of the report until her final day in office..?

Here's a thought: let her publish it and find out. It blows my mind that this POS has any rights to this report prior to it being published given that he is the POS being investigated. In what universe do mob bosses get to interview witnesses against them for example?!? They'd all be slaughtered, obviously.
