Does anyone know what the process is to obtain one in CPT? I was divorced in CPT about 10 years ago and am getting married next weekend and have now been told I need my divorce certificate.

What a mission, apparently I need to get it from the high courts or something rediculous.
 
My sister has recently discovered that she has lost her copy of her divorce certificate. yes you do need to apply to the high courts. It helps if you have your divorce/case number.

It is also far easier a process to get an attorney to apply for it on your behalf, so if you have any friends in the legal profession!!!

Why do you need your certificate?

I'm divorced, never got a copy from my ex (we are still close friends so not an issue) and had no problem getting re-married. The Dominee that re-married me originally requested a certificate until I refered him to an online site that confirms your marital status with the department of home affairs.

That was 3yrs ago and since then he has only ever used that site for the all weddings he now conducts:

Just don't mention you are divorced. Is it the overly concerned dominee making sure he doesn't send one of his flock to hell for polygamy that's asking?

I got mine on Tuesday at the CT High Court. It doesn't take to long, provided you have your case no., and get there early. I got there at 9:15, and was done by 9:30. Good luck.

The law firm that did your divorce should have a copy. I got a copy of mine from my lawyer once.

Our "Dominee" was rather with it and married us on a wine farm - law requires a fixed structure over your head and a door/exit has to be open at all times (made me laught about that one)
 
Turns out this is easier than expected. A friend of mine works for a law firm and she got the court messenger to organise it for me.

Certified copy of divorce certificate - Check
Final divorce decree (or whatever it's called) - Check

All done, this woman worked wonders, took her less than 24 hours to sort it out.

Remember the Dominee telling us this. The structure under which we got married was considered good enough for him.



Where May I Marry?
According to the Marriage Act, the ceremony must take place in a church or other building used for religious services, or in a public office (such as a magistrate’s court) or private dwelling. During the service the chosen venue must have ‘open doors’ and the service must be conducted in the presence of the parties themselves and two witnesses. A marriage service conducted without two witnesses is not considered legal.

May I Marry Outside?
If you plan to marry in a garden or on the beach, it is best to repeat the legal part of the service indoors so as to avoid any doubts about whether you are formally married or not (see 'Where May I Marry?' above). The same applies to marrying in a restaurant or other building not defined by the act. However, as long as your marriage is solemnized by a competent Marriage Officer, the courts are not readily inclined to declare a marriage invalid simply because it was held in the wrong place.
 
ok have to revive this thread. My fiancé needs a copy of the divorce decree for maintenance court next year. We do not have the case number anymore and we also do not have the decree only know it was done through Roodepoort court and finalised there. Can a person just go there without a case number and still manage to get decree as this is a matter of urgency now that we get it. We also going to need it as we would like to get Married
 
Necro alert.

I'm trying to help someone out. He's divorced and the bank wants a copy of his divorce decree - he's not on good terms with the ex and does not want to ask her. Has any of the info in this thread changed? Go to the high court and apply for a copy?
