I was wondering when the Poison Ivy and Stalin-Mafole would launch their next attack against the smoke & mirrors competitive telecoms environment.

Perhaps there was a doughnut shortage at the Dementia of Communistications that skrikked Poison Ivy & Stalin-Mafole wakker to the impending danger of neglecting to further protect Telkodemonopolies.

good news for the rabid ic is that high court action will be launched next week to eradicate some of the smoke and mirrors ;)....if the outcome is successful then the ministerial determinations will be seen as the irrelevance they are as will the licence conversion charade unfolding before our eyes

The most sought after licenses in the new local telecoms licensing regime are individual ECS and ECNS licenses which allow companies to build networks and provide services countrywide.

individual ECNS is the big prize as it allows a licensee to roll out a network of a national or provincial scope

individual ECS is less important - the "individual" simply means the licencee has access to numbers and therefore can offer interconnected voice services over a network

This has however changed with fewer individual ECNS licenses to be awarded and hence less initial competition in the network provisioning market.

The companies earmarked for individual ECS and ECNS licenses are Sentech, Telkom, Neotel, Cell C, Vodacom, MTN and Wireless Business Solutions (WBS aka iBurst).

mmmm - i would disagree and say that currently there are likely to be more individual ECNS licences granted and therefore more competition....

Initially many first tier ISPs, including Verizon South Africa, DataPro (aka Vox Telecom), Internet Solutions and MWEB, were under consideration for an individual ECNS license.

Questions have been raised about the processes which were followed regarding the potential conversion of certain VANS licenses to individual ECNS licenses, and this may result in legal action from unhappy parties.

those named in the first paragraph will still get the individual ECNS licences

the big ? here is self-provision. I am quite happy to state (along with the majority of telecomms lawyers and many people within ICASA) that a VANS has the right to roll out its own network with no geographical restriction. Hopefully the High Court will shortly agree. If it does then the ITA process is irrelevant - all VANS must be converted to individual ECNS UNLESS they choose not to take it up due to the regulatory burden and under-serviced area obligations which will come with it

and while i am ranting...
- ICASA has got the conversion to ECS wrong...all VANS currently have the right to numbers therefore when converted they must still have this right. accordingly all VANS must also be converted to an individual ECS
- ICASA have also got it wrong by not including VANS granted after 19 July 2006 and this will come back to bite them [explanation too complex and i have a plane to catch :)]

As a matter of interest, if Poison Ivy & Stalin-Mafole appear in court [unlikely I know], would it be illegal to lobby soggy stale doughnuts in their direction?

Where can I get a copy of the following notices?:
“The standard terms and conditions applicable to individual and class licences have been finalised in Government Gazettes No. 30530 and No. 30512 respectively. The licence exemption regulations will be finalised in January 2008,” ICASA said.

30530 & 30512? - I've clicked on so many links on that page, gave up and searched through the html source of that page, and there is no reference to 30530 or 30512 that I can find :confused:
 
look for the subheadings

both are links to the actual gazette...
