The board warned punters, organisations, banks and Internet providers which advertise or facilitate online gambling that they would be prosecuted. It said this would be enforced by monitoring Internet gambling.

Another example of stupid decisions - however:

Lets hope they start by prosecuting telkom for facilitating online gambling

I am a 3D animator working in cape town for a group of online casinos, our clients are in America and Europe. As long as you have a license and your clients are not in SA you can run an online casino.

Got to support 'the little people.' Oh no, vested interests always triumph over capitalism.

Online gamblers in South Africa could be fined R10-million or jailed for 10 years.

To ensure that the government achieved the goal of generating more revenue for its coffers, it had to institute proper controls.

Afaik online gambling is illegal in America as well.

You sound like that farmer who manufactures gallows in the UK for export :D

Well Telkoms infrustructure is instrumental in the crime but its a dangerous road to take, what may be an interesting road is to check whether telkom is taking reasonable precautions but that would require it to respect something

That's friggin' hilarious when DerivCo, probably the biggest producers of online gambling software, are HQ'ed in Durban. Or rather that's where all their developers are (in a massive and very nice custom built office building in Umhlanga), the actual corporation probably is in some tax haven in the Caribbean....

Running an online casino has been illegal in the US for a while which is why we run it from here in ZA, our US sites are still up and running, we just dont use cc's anymore (not directly anyway, there are loopholes but thats another story). I wont pretend I know all the laws, I am just an artist ;)
We are moving more towards the UK now, and since we mostly do bingo there is actually a bigger market there for us.

Just got an email from Piggs Peak Casino in this regard:

Dear *****

You may be aware of the current reports in the media, with regards to a matter being heard in court, with respect to the legality of internet gambling in South Africa.

Casino Enterprises initiated this court action in 2003, on the basis that we believe that playing on the internet with Casino Enterprises is legal, as our servers are in Swaziland, part of the common monetary area, and licensed and regulated by the Swaziland Gambling Board.

This legal process is ongoing and we have been given, by the Judge of the High Court, a period of time to submit amended documentation to support our case.

We understand that the current press coverage may be troubling to you, our valued player. We assure you that we have at no time intended, or ever intend, to take part in, or promote any form of illegal activity, and should this situation change, we will notify you immediately.

Should you have any further questions, you are welcome to direct them to me on the email address [email protected] and I will revert to you as soon as possible.

Kind regards,

Wendy Graaf

Can someone please clarify something for me:

If I punt from a PC in SA on a online casino based in Isle of Man or the likes. and That casino does not advertise or promote itself on South African sites or in SA media. Is it illegal? and if so where is the law that states this?

Isle of man actually .... www.microgaming.com is the holding company. Derivco the software development house.

Scary...

How is this going to be done exactly? Perhaps we should be more worried about the monitoring than anything else.

This is all hype.

"In contrast to the United States government's criminalisation of online gambling, the South African government is legalising the industry in an attempt to regulate and control it.

Online gambling -- said to be worth millions -- is currently illegal in South Africa, but the Department of Trade and Industry has given a draft amendment Bill (which will allow for the licensing of online casinos in South Africa) to the Cabinet for approval."

From the IOL article:

"It was recognised that gambling can be dangerous for individuals and that they have to be protected by way of controls"

**** you. I'm an adult. I make my own responsable decisions.

It also has to be unconstitutional to monitor my internet traffic.

So basically they'll only allow it if they can tax it and get their cut.

I would read it that way but they will say that if they regulate it they can "protect the punter" were as if it is illegal then they cant protect you from unscrupulous companies.

This is just my personal opinion but I think to a large degree it depends on how you view the law. First of all Piggs Peak is licensed in Swaziland (Rand currency area) and their servers is located in Swaziland. So in effect you are gambling in Swaziland. If the servers were switched off in Swaziland, then you cannot gamble, it is that simple. Despite the court ruling it will be extremely difficult for the courts to prove that you are guilty of a crime when playing in Swaziland. This court ruling and scare talk means nothing to me at this stage, they will not be able to win any court case against any player in my view, I mean the act is taking place in Swaziland. Your PC can be compared to a vehicle and the road is the internet... Just my view, but even with the court's ruling in this case, nothing has changed...

NO ruling has been made. The case as was expected has been postponed in order to allow Piggs to introduce further documentation for evidence. This means that the next time this is in court is next year sometime.
