for a company that is so paranoid about its image they really dropped the ball on this one......

Sure its unethical...but...

In an industry where there are so few key players staff inevitably migrate from one company to the other. often going back and forth several times. It is naive to imagine that crucial company information will not accompany those migrating staff. It happens all the time and will contuinue to go on. Verizons problem was that they got caught red handed doing it. Im sure companies looking at this case will make sure they encrypt and secrete their competitor data more carefuly in future...
Is there really any way to stop it? I still maintain that if you provide great service at a good price it wont matter what your compititors do, your customers will stay loyal.

So what you are saying is that it is OK? So I am allowed to take software written for a previous employer and sell it to my new employer, who is in direct competition to my previous employer?

It is unethical for an employee to pass on confidential information from a previous employer and I'm sure IS has an confidentiality agreement (NDA) with the employee. He should be prosecuted and sent to jail! Make a good example showing this is unacceptable behaviour.

I wonder if he would put IS and Varizon on his CV as references...

@Andres101, No,Im not saying its O.K. and I did actualy say it was unethical in my subject line, I was just saying it was very difficuilt to police. Jail may well be a good way of discouraging his kind of thing but then the Verizon Sales manager at the very least should also go down if he/she knew anything about it. In terms of NDAs with the limited number of Top customers in the country (>1mill/month) as a sales droid you are almost certainly going to be visiting your old customers (after all its you job to sell to the big boys and there are not many of them) and I fail to see how you could not be influenced or use info acquired from previous situations/employment.
Your software argument is a little different as a program is actualy a product or thing whereas competitor info is a bit different. That said, I would like to reiterate it is a "bad thing" and not something I'd feel comfortable doing (esp if it meant a hefty jail term )
