“A homeowner, unknowingly, while in his yard, was confronted by an armed African male suspect who attacked him viciously. When the homeowner attempted to defend himself, [he] shot at the suspect,” said the private security company.

“The suspect was declared dead by medics while the homeowner was being treated by KZN VIP Medics. The patient had to be transported rapidly as the bleeding was excessive.”

Police are investigating a charge of murder. The homeowner was admitted to hospital.

People overreact to this. He is not charged with murder, but when someone dies the police have to check that the story pans out. Imagine the guy shot was the mans gardener and he found out he slept with his wife. He goes into the garden and shoots him dead, stabs himself and then puts the knife in the gardeners hand and concocts this story. Someone has to check, every time. These articles come out all the time and in 99% of cases the person defending their life is fully acquitted. It is not a bad thing to just check out the story though when someone's life ended.

Isn't it a formality? But wait, do not worry... this thread will be visited by keyboard legal experts soon telling us what's up

Who opens the murder charge though? Or do the police do it on behalf of the dead criminal?
The police I would imagine, from what I have seen from these home invasion cases, the charge is murder but it seldom if ever gets to court.

In general things seldom get to court. Police are as useful as a wet slice of bread.
remember that the police themselves come from the same community and know that these fockers have been terrorizing people nonstop. Nothing will happen to the homeowner .

I can tell you that this once very passive community has been pushed to fight fire with fire .
They are organised, united and not as dumb as those cnuts perpetrating crime

I understand that the defendant's weapon is usually confiscated for the purpose of the investigation. What are the chances they get their weapon back, in working order, and roughly how long would that take?

Yes, you don't mess with Phoenix. The racist rioters realised that quickly.

Ive read where it can take years and there is no guarantee it will be there when you are able to collect it...
But I've also read where the weapon wasnt taken so who knows...
Luck of the draw...

Anyway well done to the victim...removed another useless thing from society that had no place here at all...

Well, in that Ixopo case the SAPS used the confiscated weapon to shoot and kill the prosecutor. Bumbling or deliberate; you be the judge.
