Hi guys
I hope you can help me out here. I am facing a huge dilemma.
When I was young and reckless in 2003 while studying in DBN, I impregnated this lady who is way older than me and we had a baby girl.
I took full responsibility and accepted her as my child and my parents (at the time) gave her a monthly allowance for my daughter.
This continued until I was able to find employment in 2005 and I took over everything, from medical aid, nursery to nutritional needs. I also give the mother a 'gratitude' allowance of some sort... Because raising a kid is no child's play.
Needless to say, I have been pretty much hands on in raising my daughter. But her mother and I have not really seen eye to eye due to the fact that the relationship soured over time, but she has allowed me full access to my kid.
This continued until she found out that I am now engaged to be married, then the monster in her revealed itself. She started being nasty. Denying me the right to see my child by always making lame excuses.
Things got worst when she called me to say that her doctor had identified a temporary medical condition with my child that requires that she be operated on. The doc sought authorisation from the med aid company and it was granted.
My issue here is not that I don't want my child to get well, of course I do, that's why she's on my med aid. But I asked the baby mama if I could get a second opinion from another medical expert, especially regarding the need to operate.
She refused
... saying it would delay the whole process. << this is nonsense because my doctor said it won't take long to do the check up and establish whether doing an op is the only way to go because an op must always be the last solution.
She still refuses and I am at wits' end trying to reason with a rebel that she is.
Now as a father... what options do I have in terms of all the applicable laws... I understand that the law often favours the mother.
Some facts
> my daughter uses my surname, even on the certificate of birth
> I pay all her hospital bills and I am the main member of her med aid
> I pay for the helper, food, school and all else
> I have the original birth certificate
> I would die for my daughter
If push comes to shove. Thanks to the recent e-Tolling case in point... Can I approach the court for an urgent interdict to stop the op from going through and can I force the baby mama to release the baby for another med check-up.
Please advise me because I am getting all emotional and I don't wanna do something I might regret.
