AARTO declared invalid and unconstitutional

JOHANNESBURG - The Pretoria High Court has declared the Aarto Amendment Act, on which the planned demerit system for traffic offences is based, unconstitutional and invalid.

The court delivered its ruling on the constitutionality of the Aarto Act on Thursday morning.

The Organisation Undoing Tax Abuse (Outa) challenged the constitutional validity of the Act and asked the court in October 2021 to declare both the main Act and the amendment Act unconstitutional.

Judge Annali Basson found in favour of Outa and agreed with its position.

But: "The court directed the Minister of Transport and the Road Traffic Infringement Agency (RTIA) to pay Outa's costs."

The government doesn't care, it is tax payers money in any case.
So we all indirectly "contributed" to OUTA. :) Works for me.

I donate to OUTA every now and then - they are a good organisation :thumbsup:
 
In her ruling, Judge Annali Basson found in favour of Outa and agreed with the group’s position that the legislation unlawfully intrudes upon the exclusive executive and legislative competence of the local and provincial governments envisaged in the Constitution, preventing local and provincial governments from regulating their own affairs.

Back to the drawing board for the ANC.

Yes, I agree fully.

Maybe I should clarify my post.

I was not complaining that OUTA is going to be paid. My point was that government doesn't care that they are dragged to court by organizations which have a clear case becuase it is not "their" money they are wasting.
If they listened to OUTA from the start, the court case could have been avoided, but "NO!". Hard headed.

There are many other examples.

So I am not happy that our money is being wasted on things which is clear cannot be properly defended.

Time ministers are held accountable for money so wasted. Especially if a Law is passed which they pushed through and it ended up being thrown out by a court of law. Make THEM pay then. Maybe they will start thinking more about their stupid actions as it could affect them personally. (Just like each of our actions we do every day affects us personally).
