AARTO declared invalid and unconstitutional

But I bet Vrotappel is amongst those who were jumping up and down with excitement when Zille was accusing the judiciary of things, no idea why he is now interrogating me as if I have said something that hasn't been said before.
 
It's interesting that it was ruled unconstitutional on the basis that it overrides provincial and municipal rights to regulate their own affairs. This is an important precedent that can apply to many other areas of governance.

I don't see how they can fix AARTO easily to align with this. And even if they can, there are other constitutional issues with the act - i.e. it removed your right to defend yourself in court.
 
Yes!! Been getting an SMS to collect my AARTO infringement at my nearest Post Office. Guess they can shove it now.

Understood. But to be honest, I am in a less of a hurry now to go pick it up.

Generally most of the fines I have given fairly :) so I have no problem paying.
Do the crime , pay the time as long as it was fair

Also with all of the family cars on my name I dont want the wife/son being given **** at a roadblock.
 
Didn't know a high court can make a judgement on constitutionality? I thought that was concourt territory?
 
As far as I know it can , but it can allways be appealed by the constitutional court

It can but the parties can appeal each court all the way to the constitutional Court. After the CC makes a judgement then there is nothing else that can be done.

Depends on how hard you want it, how much time you have, how much money you want to spend.

Now to rally up all those cadres in the appeals and constitutional court and make them earn their salaries!
