Accidents and Towing!

So, you are not legally bound to have your car towed by any towing company.

But:

The National Road Traffic Act 93 of 1996 and the National Road Traffic Regulations published in Government Notice No R.225 of 17 March 2000 stipulate the regulatory requirements for the towing of vehicles. The act states that ‘...no person shall remove a vehicle involved in an accident, except for the purpose of sufficiently allowing the passage of traffic, without the permission of the owner, driver or operator of such vehicle or a person who may lawfully take possession of such vehicle.’


This Act empowers a traffic officer to have your car moved off the road if it is obstructing the flow of traffic. Be careful to select the correct service provider as, once hooked, there have been reported cases where the tow truck driver then refuses to unhitch the vehicle and when denied the onward tow, demands the full price of an accident tow for the five metres the car was moved to the side of the road.

WTF...yep, not letting these bastards tow anything of mine!

Problem is if you're incapacitated from the accident and have to be rushed to hospital. You don't really have much of a choice in that case.

As said they're only towing it off the road and then charging full price for a tow.
 
Theyre a dodgy bunch..

I heard that they cut power to robots to cause accidents.. that they have gsm blockers to stop you from phoning for help on your cell.. that they pour oil on the road.

No way I let them tow my car.

Ja but this is the reason why most people have that ugly sticker on their cars saying don't tow etc..

Hi guys.

Just need advice. I was in an accident yesterday, my first ever, u was so nervous and in shock. The tow truck company amm in goodwood was rattling in my ears all the time, someone drove into me, we both not insured. I asked the tow truck how much to my house as I stay 2 km frm the accident. He said 650. Then I said no its fine il put on a spare wheel and let phone my brother to tow me. He said no if you going to do that, the 3rd party won't pay out. So I said I'm not insured as well as the woman, he said no all I need to do is fill out the AR at police station, and they will do the rest, I will get a call in 2 days time for payout, and they won't charge me at all as the 3rd will pay them out. So I shouldn't put the spare wheel on then I won't be able to get any money from this woman.in shock and not knowing wtf, I agreed, he said I should just sign in his book. And what a flippin mistake. I went to police station to fill out the AR and the policeman on duty told me it's best I get the car back as this towing companies are crooks, and u can't claim unless 1 party is insured. And they going to keep me responsible for all charges and storage fees etc. I eas even more stressed out and went immediately to the tow yard and the guy said I must pay 4000 to release my car. Told him I was lied to because if I knew it would cost 4k I wouldv stuck to putting on the spare wheel. He said no I signed,amd if I see the fine print behind thepage it states there. I want to know if I can take them to small claims, ombudsman, Utasa and CPA,for being misled, lied to and overcharged. And if I stand a chance.

Try the CPA you need a witness to backup your story
 
No because that's not the same thing as no insurance
 
Don't sign anything for tow trucks. Let insurance handle it. No insurance, use your head and just say no. Also whomever gives the instruction to have a vehicle moved off the road is liable for payment.
 
But if he had 3rd party he'd still be in the same predicament. :unsure:
But he'd be shown to be a more responsible adult and I could find some sympathy.
Yes I'm judging. Yes I had an uninsured driver drive into me. Yes I'm paying the increased premium.
