So then throttling isn't a penalty either by that definition.

I have never said throttling in and of itself is a penalty - HOWEVER describing a person as an "abuser" and consequent upon that "abuse" throttling their connection speed is a penalty - a punishment for allegedly "breaking a rule" imposed by the ISP.
Throttling however requires that the softcap type limits or policies be published and you then can't call the service unthrottled.
 
Perhaps penalty is the wrong word but heavier users are more affected by shaping than lighter ones, correct?

As I said, for the moment they are yes - and we aren't happy about it either.
With the roll out of the increased capacity shaping should ease up for most of the queries that we're seeing here.

Crimen iniuriae. Would be interisting if someone brought a case, if possible, againts an ISP for this.

Agreed, but then anyone who breaches an AUP is still considered an abuser in my books. The limits and conditions of that AUP should be clearly defined of course.

No judge is going to take a crimen injuria charge seriously for that. Neither would anyone else.

but the conduct really is within the scope of insult to person of a barely civil nature and even there barely

what would be quite imaginative would be to go the cease and desist and interdict route - I am not advocating such a course for want of exceeding a de minimus standard, but it is more than of a little academic interest to me

if you want an unshaped service Afrihost business does that for you - so paying a VPN provider rather than the extra to Afrihost is simply to be a manipulative schmuck


Now on the indication of you intention there is abuse - intentionally seeking to by-pass the network demand management systems for that purpose -- see the AUP, common sense and international best practice.

Bypassing shaping on our network isn't cool :( That's why our AUP is in place and protects all of our users.

You shouldve got the business account,

I read these forums and some people just want to rip as much data as possible for as cheap as possible, if they want torrents all day at full speed get the damm business account
