I think he has to say stuff thats untrue for it to be considered defamation. I have been getting shaped to 1/5th of my line speed until 11.30pm on weekend days. Currently im being shaped to 1/10th of my line speed, its long past after hours.

They aren't stealing my money, and the ship isn't sinking...

Please exclude me from your actions. I am happy with the service I receive.
Also, fairly sure this post is defamatory...

What I have written is not false in any way, this is what I am experiencing at the moment.

I have edited the section, "stealing", as it might be construed as me accusing them of a crime of theft, which is not the case, hence the term essentially.

Besides that, no one will be included in an action automatically, that is impossible without formal instruction to an attorney.

*edit* sinking ship is a matter of opinion...

As I am typing this I am unable to properly open websites and failing to download even a 400kb file. When I download, my nzb's and torrents are shaped to 1mb even though I am paying for a 4mb account.

We are sitting here with a situation which resembles a supplier promising a service and a consumer paying for that service while the supplier is not delivering said service.

I have now come to the conclusion that Afrihost/Axxess are violating the requirements for a service by a supplier as set out in the Consumer Protection Act, even if they try to cover their shaping under fair use policy.

We are paying for something we are not receiving.

This is cause for an action before the Consumer tribunal and then later court if it continues to that point.

I am employed at a law firm and will most likely have the resources to start this action, I am currently doing my research on exactly what it is that we need to request from the tribunal to rectify this ridiculous situation.

Afrihost/Axxess are essentially taking, without repercussion, consumer's money at the moment and getting away with it because not everyone has left the sinking ship. This is not right.

I will post again once I have finished researching.

OK so maybe I won't be going with Afrihost :P Is this the general consensus?

Well yes and no , Afrihost has been awesome for me over the last two years with a few minor hickups and its the only reason i haven't cancelled. However these last two weeks have been really frustrating. The thing thats even more frustrating is they cant even give us an eta, will it be 1 day or 1 month?

I must also say, I have been with AfriHost/Axxess for the past two years and the service was excellent. I have never had problems with them. Only now with the transition to the MTN backbone has the situation changed.

They are working on the problems, and honestly I think the men up stairs are pulling their hair from their skulls, because of the backbone not performing as it should.

It is a messed up situation, but it has now resulted, for me, in a waste of money on a service which is already so terribly expensive in South Africa.

Download Speed: 458 kbps (57.3 KB/sec transfer rate)

Upload Speed: 404 kbps (50.5 KB/sec transfer rate)

Latency: 77 ms

I've been researching what package to go with over the past few weeks and it's been slow speeds across the board. WebAFRICA less so. But Afrihost and Mweb. OpenWeb has been getting bad feedback because speed differences between Gold and normal accounts seems the same speeds and shaping protocols are identical.

Still it seems to be a coin toss

Crying over spilled milk if you ask me

22:30 and the download speeds are slowly creeping up - 200Kbps now.

Spoke too soon - jumping between 150Kbps and 200Kbps.
