Hallo,

Long Story:

My family has been renting through an Agent since last year around this time. They were desperate for a roof over their heads and moved into the property without having any other options. After moving in, the house was in poor condition as the previous rentees didn't clean it up, garden was a mess and they left their rubbish all over. But my family cleaned everything and got rid of the rubbish themselves as the agents were useless. Lots of things damaged in the house. My family created a list of everything as well as took photos, but the agent never did anything. After various emails from the start and during the year and after the rent was paid from the start, they requested for the contract to be sent but the agents kept on ignoring it. So no contract and no support from the agent to come look at the property or do something about the stuff that is broke. Family made contact with the owner, the owner said they can fix stuff and then deduct from rent everything they fix up to X amount. This was then also communicated to the agent. Some big and important things that needs fixing however is still ignored. But they have a home, and they are grateful.

Fast-forward a year.

The agent sent an email that the rent is going up 10%. Taking in consideration the lockdown that left them without an income for a period of time (and still paid their full rent as the agent refused to negotiate, either pay or pack your bags), as well as having reduced income due to lockdown and the state of the property, they asked if the 10% increase can be negotiated please and if the agent can please send the original contract as have been asked many time. Agent ignored them. Family phoned the owner and the owner said they do not want them out of the house and yes they will only increase rent X amount. This was then sent to the agent. The agent then responded and said they must pay a renewal fee. Family replied back if they can please get the contract and see what it says about the renewal fee. Agent ignore them.

Almost done....

TL;DR:

Now the agent sent another mail their contract will not be renewed and they must vacate the property by the end of the month. No reason given. Phoned the owner to ask what is going on. The owner said they do not want them out of the house they can continue to rent, but the owner is looking for another agent as she is not happy with the agent.

So what now. Technically the agreement is with the agent (even though they refuse to send the written contract). But there are issues between the owner and the agent. My family don't know what the issue is and what the contract between the owner and the agent says

What can my family do now?

Do they listen to the owner and stay in the house but their "agreement" is with the agent.

Or can they get taken to court and be left on the street.

What about their deposit with the agent.

Owner trumps scumbag agent every single day of the week. + No contract. Just ignore the agent and ask the owner if you can pay rent directly to him. Let him take it up with the agent. Sign contract with owner ASAP!!

That is what family is trying to do. But not sure if you allowed to go past the agent directly to owner? We not sure if the contract between owner and agent has been terminated and what it says. They sent a contract to the owner if the owner wants to use it. But yes, they will try urgently to get something on paper if possible.

The thing is, can't remember if there was papers signed in the beginning and then handed to the agent who was also supposed to sign it and then send a copy to my family but never did.
 
Agent also said they will come do inspection end of month when they are moving out and if anything is damaged it will be deducted from their deposit. But they did keep proof of everything that is broken and was reported.

The agent is the owners problem. And if you have proof of requesting the signed contract you have covered yourself. Just ignore the agent. They cant do sht.

Just ignore them. Dont allow them in the house. If they refuse to pay back the deposit, which they will, you need to approach the housing tribunal I think. But strictly speaking the owner should grow a pair and sort this crap out.

That is nice that a lawyer give facts. Kindly would you sponsor it or refer me to a lawyer friend that will assist?

Lots of knowledgeable people on this forum. If I don't find a solution or at least some kind of usefull advice we would try another desperate route.

pretty much this get a contract signed between the owner and the tenant asap , if the owner wants to deal directly wit the tenants that is fine , if he has any clauses in a contract with the agent that's between him and the agent

Thank you. We are working hard on this and trying to make the owner get some kind of agreement on paper. But looks like the owner is looking for another agent. So not sure how long that will take etc.

The owner sounds like a weak minded punk who will drop your family in the sht at the first sign of trouble. They really should try to find somewhere else to live.
 
can you guys not draw something up maybe use old contract as a template and sign it with owner
We have done that and will be sending it tonight. But as I mentioned above, looks like the owner is looking for another agent. In the meantime my family is in the dark with the agent telling them to move out and with the owner telling them they don't have to move out but also not putting anything on paper yet.
 
If the owner has a contract with the agent it probably states that they can't lease to the same tenant that was introduced by the agent after cancellation of the contract. Its probably going to be a messy situation so tell them to be prepared to move if things go south.

ok sounds like the land lord is a bit weary of dealing without an agent , but still wants you guys as tenants.
so you can sit put - also the old agent is trying to kick you out but he cant do jack , so sit put. seems as if the agent and your land lord had a falling out and now agent is trying to make kak. So tell him he can F right off the property isn't his and he has no legal claim to say or do anything. So sit put

and legally a mission to kick any one out and at least this doesn't seem like you guys not paying rent and the landlord wants you guys so you A ok, I know its a bit stressful, but like i side the way you describe it you still have a home (from the land lords perspective)
