Interesting new brainwave by Nqakula. The propasal explains changes to what weapons a person can carry on them. The legislation proposal apparently means items such as a pepper spray or any item that is designed to injure, disable, or invoke fear on another can't be used legally in public.

Feel free to read and explain the Nqakula thinking here. I've had a glance and can't belive that things like pepper sparay can't be used for self-defence?

Is it not my CONSTITUTIONAL RIGHT to protect myself?

It falls under the Scehdule 1 point17. "Any other article, which is not a firearm and which is made or modified to be used"... blah blah. (page 4 of 8 in the PDF)
 
According to the constitution

Everyone has the right to bodily and pshycological integrity, which includes the right to

security in and control over their body

Bill of Rights - Chapter 2 sub section 6 sub sub section 2(2)b

in my mind the right to protect yourself

but this brings into question the entire Dangerous Weapons Act, the problem is that if you do that and there is no licence regulations on weapons, Police would have their hands tied when dealing with potential criminals

That aside, the serious question

can I not now take my cross-bow or paint-ball gun anywhere now, as if the Police find it in my car, on a public road I am in doo-doo

Nope. Remember criminals are victims too. They don't need you compounding their problems by you infringing on their human rights ;)
 
It does'nt say pepper spray, but it clearly states that you can't use weapons that work with compressed air, springs or gas.

OBJECTS WHICH ARE IN THE OPINION OF THE MINISTER
DANGEROUSWEAPONS

Any other article, which is not a firearm, and which is made or modified
to be used -
(a) to injure or disable a person;
(b) to cause a person to fear that someone will be injured or
disabled by that use; or
(c) for attack or defence in the practice of a martial sport, art or
similar discipline.

by that definition... screaming is also illegal as it might hurt someones ears. :D
 
The guavamint is trying (and has so far succeeded) in removing weapons from the populace.
It is much easier to be a tyrant when you control all the weapons.
 
Question to the lawyers:. I would like to test this law on two points in as far as exemption 1 (e) which states “for the pursuit of any lawful employment, duty or activity;”. Does self defense qualify as a lawful activity. And secondly exemption 1 (f) which states “for the participation in any lawful sport, recreation or entertainment;” Could a court dispute that I was wearing my weapon as I was going to the shooting range which should qualify under the recreation of exemption 1 (f).

And does 17 (a) include pepper spray, tazers etc etc.

Come on guys what do you think?
