Are hotspots licensed?

does ICASA have rules around setting up hotspots?

For example, M&B down the road is using the HotCity stuff. So if I go and build a little open-source system, shove in the needed hardware and set it up at the Wimpy next door and charge 20% less, am I breaking any laws?

I don't know, but even if you were, there's nobody to enforce it anyway. It's a free country, do what you want!
