Arrested for drinking and driving

pfft after 2 bottles of wine I still drive more responsible than 50% of the Eastern Cape

Serious note.. it's an interesting subject, as alcohol & medicine etc. have way different effects on people. But guess they have to enforce some rule.

EVERYONE thinks they drive better than everyone else when they are drunk. It's like butt rape, just stay away from doing it all together.

Hey y'all, OP here with an update. I had my big day at Bryanston Magistrate Court on 8 May 2014 and I don't know if it was because it was right after voting day but my docket wasn't there so I got my bail back and bailed. Was done by 11h00. Just an FYI, always take a lawyer for your first time or if you are unsure because no one will tell you anything! they won't tell you where to wait, where to check if your docket is there or even that the dockets for that day have to be delivered to the Senior District Prosecutor by 10h30 or it won't get posted on the board (the board that no one tells you existed) and therefore you won't get seen that day and can leave (no one will tell you that either). So basically I had an awesome lawyer who kept me company told me where to check for what how long it will take etc, even got to sit in a few court rooms and watch our justice system in action while i waited for 10h30 to roll around. At 10h30 my lawyer went to see the Senior District Attorney and came back 10 minutes later saying that they looked through all the dockets and mine is not there and that we can go! btw I had a mate who was all cocky saying he would not get a lawyer etc.. so i thought ok I won't tell him what I know he can figure it out. I chatted to him the day before his case which was a week after mine and he was like a dog with his tail between his legs all scared and asking me all these questions so I told him everything I experienced. Hope someone finds it useful. Still don't even have a beer now when I go out and am driving, I have been reconditioned by the penal system, actually not reconditioned just scared of the long and hard penal system. My man card has been revoked by my mates as a coke zero is not a fitting beverage for a man at a bar

I don't think any of us is in a position to judge you, and I am happy it worked out ok for you. This is one self-inflicted experience that everybody can do without. Stay off the booze, crack, chronic, sweet mary jane, bionic, hookers and highways now, you hear?!

Do what I do, get mate to pick you up and use Uber to take you home. It will cost you that extra R150 or so dependent where you are but its well worth it.

Download the app and start. They often have promo codes at events (beerfests etc) that you attend that seem to expire after the event, but should you not find one you can use mine as a last resort.

Pretty much, yes.

But the car, driver etc must meet their requirements. So the car needs to be a 2010 or newer C Class, 3 Series or A4 (or better). The car has to be spotless in and out at all times. They market themselves as a private driver rather than a taxi service

You get most the fare - they take a commission for allowing you to join their system.

Had to be at SAPS Douglasdale to open a criminal case on Saturday and I was amazed to see how many people had been locked up from the night before due to drunk driving - SAPS had a queue out the door from the holding cells for people bailing out their co-workers, friends etc.

OP was calmer in all of his posts than I would've been. Many years ago I pranged a car into a bush after a night out. Learnt a big lesson from it and was lucky to walk away with just an insurance claim.

So Sunday morning at 00:24 i was caught for DUI. There was probably about 15 that got arrested for DUI at this location. Yes i know it's wrong to drink and drive (Don't all jump on my head). I took a nap aswell before I drove so I wasn't drunk but still over the limit as per the breathalyser. Took my blood and all my details and stuff. Got bailed out Sunday Morning at 08h30 - was told that they keep you in the holding cells for atleast 8 hours to sober up and release you if you have the bail money.

We all had court dates for yesterday at Randburg court. Wasn't as well sure about the procedure but we asked a prosecutor who told us we had to wait until our names appeared on the board. Under blood results it would state "Nolle" or "N.O.R" meaning that because the blood results has not been done as yet your case will Not be Place and you don't have to appear in court. Then you just go to the cashiers and recieve your bail money and then the investigating officer has to phone you or send you a summons stating that the blood results has gotten back and when you have to appear in court.

Now when at the police station while the police officer was releasing us, taking our finger prints etc. She said that if after 6 or so months no one has gotten back to you and no court date has been set you can go back to the Police station to have your name cleared and the case withdrawn. Does anyone know if this is the case?

And yes I have learn't my lesson with regards to drinking and driving. Rather sit at home and drink and stuff plus December is around the corner so expect lot's of Roadblocks guys.

I know we chatted about the Uber thing earlier, but they've launched a cheaper UberX in the meantime. You're looking at around R140.00 for a 15km trip, which isn't much. Plus get your friends to join (and split) and you'll find a one way 15km trip is under R40.00 - a single craft beer There are promos abound, so you even get a credit on your first drive - R90.00 credit worst case.

I got UberVan on the weekend (sits 8) and a 25km drive was a touch over R500.00 or R60-odd rand each.

Very unlikely anything will come of it unless you had an accident and someone was hurt.
Even if it does go the distance it's unlikely to be more than a slap on the wrist for a first offence.
Speaking from experience sadly. Take it as a wake up call.

Seeing how SA forensics blood testing is completely swamped I'd imagine you're not going to hear back in the next 6 months. Or 6 years for that matter.

That being said - its quite possible that alcohol testing takes priority for them...much like how speed trapping is more important than any other kind of traffic policing.

Will definately look into these services when wanting to go out next time, rather pay 60 bucks each than having to dish out way more cash or something really bad happening. Or just not drink and be the designated driver.

Yeah thats what the prosecutor and clerks said as well. Unless you were DUI and in an accident or speeding or reckless and negligent driving then you can expect it going the distance. But most of these cases gets thrown out.

Yeah the police officer at the station said that they we busy with backlogs of 2010 :wtf: I just don't wanna have a birthday present 3 or 4 years down the line. So just want to make sure it's not gonna come back - so will probably go to the police station in 6 or so months to ensure everything has been cleared and the case withdrawn.

If Insurance gets a sniff that there was an arrest or dui was involved they will withhold payment to both parties untill blood result are available even if case is thrown out of court

Your case has been struck off the roll pending the blood results. You'll be hearing from the detective at the police station once they have your results. It can take up to 1 - 2 years. Depending on how over the limit you were, you will get submitted to NICRO for evaluation. If accepted, you will enter their program, basically a few sessions of counselling, talks from AA/traffic cops, etc. Then you'll do community service. You won't get a criminal record.
