Arrested for drinking and driving

Your case has been struck off the roll pending the blood results. You'll be hearing from the detective at the police station once they have your results. It can take up to 1 - 2 years. Depending on how over the limit you were, you will get submitted to NICRO for evaluation. If accepted, you will enter their program, basically a few sessions of counselling, talks from AA/traffic cops, etc. Then you'll do community service. You won't get a criminal record.

But will be convicted and need to disclose it for insurance purposes - HECTIC PREMIUMS
 
I don't think this is true. It is dealt with administratively outside of the usual court system.

If that is the case then I apologise. I recall OUTsurance asking me on a quote if I have ever been convicted of drunken driving before. So it is asked by insurance companies.

Understood, a conviction would be linked to a criminal record. NICRO does not lead to a criminal record even if one pleaded guilty, it's effectively a 'second chance' for minor first time offenders.

Don't they just ask if your license was suspended for any particular reason?

I have only once or twice driven piss drunk. But loads of the time I feel sober still and can drive but know if I'm pulled over I will be jailed. The limit is very low as of late. Think last time I hear it was like one beer and you're over?

I think the average is calculated on a man of 64kg...

Basically 1.5 beers would have such a person at the limit (call it 2 units). 2 beers would be over.

The body gets rid of 1 unit per hour.

It's best just to not drink at all.

So i just have to wait it out until the detective gets back to me i guess. As per the breathalyzer i was 0.32 and the limit is 0.24. Some of the guys who they caught as were twice over the limit. One person was 3 times over the limit.

I've learned my lesson though. The crappiest parts is having to wait to be released and having to wait at the court. That felt like enought punishment lol

Sounds minor. How long after that did they draw blood? It might have come down enough by the time.
 
The effects of alcohol wear off faster than what your blood alcohol level returns to normal. So once you have been drinking, stop and then feel sober, there is a window period in which you will still test over the limit.

Plus you're perceived soberness is affected by your tolerance while blood levels aren't.

You might be fine then, but of course there are various factors. Rather don't bank on it.

What we know for sure is that you would more than likely be submitted to NICRO if you are indeed found over the limit after the pathology results.

It's a slap on the wrist and an excellent life lesson. The worst ahead is the waiting and the 2 - 3 more court sessions.

There's truly nothing worse than being in and around courts... I count my luck in life every day.

I know we chatted about the Uber thing earlier, but they've launched a cheaper UberX in the meantime. You're looking at around R140.00 for a 15km trip, which isn't much. Plus get your friends to join (and split) and you'll find a one way 15km trip is under R40.00 - a single craft beer ;) There are promos abound, so you even get a credit on your first drive - R90.00 credit worst case.

I got UberVan on the weekend (sits 8) and a 25km drive was a touch over R500.00 or R60-odd rand each.

A colleague was arrested in Durban, 7 years ago, after our Chrismas party. Needless to say, he was slapped with a R8000 fine and has a criminal record now.

Back in the day, when we partied hard(2002-2007), I would travel from Westville to Kloof, pi$$ed out of my mind, 3 or 4 in the morning. Had to look at the yellow line, through the drivers window, to stay on the road. Wife looked for rear lights in front of us. Since my colleague's encounter and a minor health scare, I have just about stopped drinking. I would only drink at home socially after that. Scared of this jail nonsense and criminal records.

Being in Oman now, it's actually easy to abstain. Don't want to get in trouble in a Muslim country.

My buddy used to open the passenger door and we followed the yellow line all the way back to our digs.
