Paralympian Oscar Pistorius started crying in court on Tuesday as his lawyer denied that the alleged murder of his model girlfriend Reeva Steenkamp was premeditated.
"We submit it's not even murder," advocate Barry Roux told the Pretoria Magistrate's Court.
"There's no agreement there, not even concession that this is murder."

There was no possible information to support Oscar Pistorius' version that he mistook his girlfriend Reeva Steenkamp for a burglar, the State submitted at his bail application in Pretoria on Tuesday.
"There is no possible information to support his version that it was a burglar," said State prosecutor Gerrie Nel.
Steenkamp, who was found dead at his home in Pretoria last Thursday, had arrived at the house between 5pm and 6pm on Wednesday night, February 13, Nel submitted to a packed court.
With Pistorius looking down, Nel said there were two people in the house.
Her overnight bag was there and a cosmetic bag was left in the bathroom.
He said Steenkamp was shot three times behind a closed bathroom door.
"The door was broken open from the outside," Nel told the court.
With Pistorius still looking at the floor, Nel said the State would say that the door was locked.
Nel said Steenkamp's body was carried downstairs.
He said Pistorius then said to a friend he thought she was a burglar.
Nel wanted to know why a burglar would lock himself in a bathroom.
"We say this in itself constitutes premeditated murder of a burglar," said Nel.
When he finished his argument, Pistorius' lawyer Barry Roux stood up to argue why Pistorius should be granted bail.

this is very interesting. But yes I think it is. If I take out the gun for a burglar I do not intend to let it testify that he is a harmless guy that only wanted a cup of sugar.
You pick up a gun knowing it is either your life or the intruder's.

Yeah, it's pretty dumb of him to think the courts are going to believe that a woman who has been in your company all evening, goes missing only to be replaced by an intruder in a small bathroom..

Doesn't really hold up when you shoot the unseen "intruder" multiple times through a locked door. I'm also sure she wouldn't have been silent while all this was going on either.

I personally feel Oscar being out on bail is bad, he will be a danger to the witnesses and the process.

I seriously doubt he will get bail. More likely a remand to a forensic psych unit.

Wow this is so sad, but I guess the defense will try anything to prove he is innocent and the prosecutor will try anything to prove guilt.

Do robbers work alone these days? No mention of looking for other possible robbers downstairs?
no there was only 1 robber, or intruder if you will. the cop was OP himself and the cricket bat was the prop commonly known as a police baton.

I still think he never planned to kill her but shot at her in a (likely jealous) rage. I think the headshot may have been an accident, but he wanted to hurt her.

That's BS. Break into my house and lock yourself in a room and you are in a world of hurt. Maybe I'll call the police but if there is a chance that you are armed and that you may come out the bathroom we have a standoff. It isn't murder. It's self defence. I will not wait for you to shoot at me through the door first.
And thinking that I should run away. Nope. My house and I will defend it.
I think the state has no case, they shot their mouths off about murder and now need to have a story to support the tale they first told. Why? Because they have big egos.
