If the robber had tried to get away and locked him/her-self in the bathroom then there was no immediate danger to his life. Pretty clear that it is still murder.
 
When you point and gun and someone, and fire shots, you are intending to murder them. It just so happens that it was his girlfriend but it's still intention of murder even if it was a burglar.

The person was hiding, locked, in a bathroom... yeah, real life threatening situation there...
