Article: Pistorius gets bail

Heres something that I would like an answer to please.

If the judge agreed to a charge of premeditated murder......and the state cannot prove it was premeditated.....is he then not guilty at all? Would the state then be able to pursue a charge of Murder? Or does he then get off?

Isn't it more risky to try for premeditated murder than just murder? He most certainly killed her, no doubt, but premeditated may be harder to prove.
