axxess press release

Axxess just better tell people in time so that they can still cancel their accounts if they want to. There is a 1 month cancelation clause I see, so what happens if the price doubles, triples, etc, do you still have to pay!

Wrong - there is no cancellation clause on their month-to-month adsl packages.

It is clear that Telkom is the one causing the delay for ISP's. So we can't really blame the ISP's for not being able to give us an answer. I find it quite ridiculous that this is all being left to the last minute. They owe us atleast 1 month notice of such a major change. As far as I'm concerned, Telkom should have let all of their customers know about the change via email. I can bet you there are hundreds, if not thousands of ADSL customers who are totally unaware of this change and it's not fair on them.

I think telkom sees the 30Gb as an infraction of the agreement they had with the ISPs so they don't see a reason to be nice to the ISPs in any way and the people who had the 30Gb accounts now have to pay

SERIAAAAAAS ?
Is AYCE going to tell us hardy 30 GB 1year subscribers to bolt ?
Is this a confirmed thing or a maybee baybee thing killa ?

Lets be trully honest here.

Axxess rely on SAIX as their ISP, and SAIX are full steam ahead with the new pricing from Telkom (duh!).

So where does that leave Axxess? *****-whipped if you ask me.

Whereas Tier2 ISP's like IS and UUNET don't have to accept pricing from telkom and can therefore offer their own packages.

And this local capping, its pathetic. Its like capping the network at a lan party. The infrastructure is there and *free*, so why degrade the service you offer to clients? I mean local peering shouldn't be costing Telkom anything, or atleast not as much as international peering.

But like they say, what you gonna do with a gun to your head? You gonna keep your wallet and die only to have it taken in vain.... or you gonna give it up and report it to the authorities (ICASA) and wait for them to take action... if ever...

I agree Telkom is the cause of the problem, but it doesn't make the ISP's blameless for being quiet, especially when the competition is doing things like this

Just out of interest IS and UUNET are Tier 1 (just like saix ) but more crunchy ;)
Also the local stuff isnt quite free....there are peering costs and even lans can cost a fortune to maintain when each client has .5 mbit...ups generatorts, fibre infrastructure support 24/7 365 etc but your point is still a good one

Absolutely! I'm extremely frustrated that the ISP's have been so quiet. Web Africa promised to give us plenty of notice before the price change came into effect. I don't call 2 weeks plenty of notice.

at least u got a response from web africa ... axxess ... I generally rave about ur service .. but this delay tactic is really pissing me off .... I suggest u guys give us feedback asap our u will find a huge vacuum where ur customer base used to b

Well I think they stand to really piss off a lot of their customers. I'll bet that most of theis subscribers don't even know about the 1 Nov thing. Small businesses and such. Imagine their feelings when they suddenly get a couple of days notice of MASSIVE price changes. Especially as the Axxess site is still advertising their old prices. Wouldn't be suprised if there are legal ramifications as well.

Pitty about the "E & O E" clause, as it gives companies that ability to change pricing at their discretion and then say "Sorry, but those are the wrong prices... these are the NEW prices."

and when questioned, some ISP's replied, "Its the customer's responsibility to keep up to date with Telkom and their pricing structures".

Not sure that you are allowed to advertise an incorrect price. Not even Telkom does that on ADSL although there are "additional costs".

But beyond that, I'm pretty sure the material on Axxess website constitutes "an offer".

Actually, that is a good point. No where on Axxess's site does it say the prices are only valid until end October. Do the Axxess accounts run from the first day to the last day of the month? Or is it valid for 30 days from when you've signed up? If it's for 30 days then you can simply sign up today and they have to honour that price.

E and OE!

Legally the correct contractual interpretation of Errors and omissions excluded, means that if there are mistakes in print that do not correctly display their intent (offer in this case) they reserve the right to make changes.

However this does not qualify as a mistake because contracts concluded under these conditions have presumably been ratified thus this is evidence of the fact that no such error (or omission) infact exists.

Thus they will most probably rely on some other clause in the contract, probably dealing with changing the technical nature of the service and so forth!

At the end of the day, the fat cats get fatter and the skinny ones get thinner.

Or proudly south africa way:
The fat telkom providers get fatter and the community gets robbed.

Nah they will go with the "Improving the service for the better of everyone" clause.

hahaha ;/

Well its morning and guess what? Nothing have changed on axxess's website.
Now why did that not surprise me? :(

for sh!tsakes this is disapointing. When will we know its getting late

Just called Axxess to ask about a 10gig account for myself and they said to wait till the end of the week. Then he said I would be looking at about R350 or the 10gig account when I asked if it was going to be a big jump in price.

100 bucks is a big increase for me. But I'm just a consumer. :(
