Ban upheld on Apple "push" e-mail

Well, yeah, this is one way of looking at this story.
Another way would be to say this is actually a FRAND issue... One more way would be that most courts won't rule on FRAND issues but German courts will, which is why Motorola chose them... Still another way would be to say that Motorola went ahead here in spite of an EU (including Germany) antitrust investigation being opened against them because of their FRAND dealings with other companies, like Apple... My best way of looking at this story 'tho, is by referencing the rumours that Google are apparently already looking for a buyer for Motorola's hardware devision 'cos really, all they wanted were Motorola's 17000 patents.

I for one am glad about this ruling. Hopefully it will show Apple that Google and Motorola will not stand by and watch while Apple sues every one for every single little thing.

And the sale of Motorola Mobility by Google...mmm time will tell...but I doubt it:

If Google plays their cards right and puts effort into Motorola Mobility and pumps out more products like the new RAZR range...well...it can turn things around and make Motorola one of the top brands again.

Ironically, Motorola were the ones that brought this case, but yeah, if the nett result of all this litigation is better phones for us, both as pieces of tech and on the price front, let 'em all have their days in court. These stories do make me wonder if I was right switching from studying law to communication at varsity 'tho... The fees and retainers must be staggering.

Apple and Motorola – which Google Inc is in the process of acquiring
Say what? Google is trying to buy Apple, and Motorola? Since when exactly?

Nope, Google is just buying Motorola... perhaps that sentence would have worked better as: "Motorola, which Google Inc is in the process of acquiring, and Apple..."

Motorola might have brought this case...but who is the one that has been suing Samsung and others in almost every jurisdiction possible? IIRC they also sued the crap out of HTC. And Apple aint no angels either when it comes to "borrowing" ideas and technology from others. Steve Jobs interview:

And just to be clear. I am not in favour of all these law suits blah blah flying around....I do wish they would all get back to focusing on giving us great phones (of which Motorola is the best...naturally) :p, but I am also very much for sticking it to the bully and punching back.

You're a Motorola man? I'm shocked! :D Yep, Apple have had their moments, good and bad, but I still love 'em 'tho.

Yip..tis true....BEST HARDWARE AND DESIGN IN THE WHOLE WIDE WORLD. hehehe

I even managed to convert my sister to Android by means of the RAZR....and she was a raving Blackberry addict that would foam at the mouth if you try and take it away from her. Now she is loving the RAZR.

LOL. So it's a race then... Best you go see the folks this weekend... My sister's now on an iPhone with an iPad from FNB on the way. Her boyfriend already has his iPad and iPhone but my niece is stubbornly clinging onto her Torch even 'tho she has my old phone which she just uses as an iPod, eish! Guess if your 16, BBM is still cool, but I'm working on it :D

You sure? I think you are just regurgitating things said by other fanboys, but regarding the wrong lawsuit... Nothing FRAND about push email.

Even though I am glad apple got a bloody nose, I still think all these patents are just used as a way to limit competition. Thus, bad for the consumer.

Second part of that post is spot on but, as far as standards-based patents and FRAND goes... http://www.electronista.com/articles/12/04/13/germany.says.motorola.ban.valid.for.now/ or http://thenextweb.com/apple/2012/04...estore-push-email-to-icloud-users-in-germany/ or even http://www.fosspatents.com/2012/04/german-court-might-ban-iphone-and-ipad.html

Just go and read the articles that you quoted:
There is 2 different patents involved. The first one is FRAND and the second one (the one we are talking about) is NON-FRAND or as said by your last link: a non-standard-essential push notification patent

Yep, that second one, unless I am mistaken, is based on a 1998 patent for pagers... Remember those?
