This should work, certain apps (bbm, facebook, etc.) and the default bb browser only work via bis though.

Correct, they need to go through BIS so RIM can record all your conversations.

It was the cell phone networks that were talking about throttling the BIS connection, so they do have a hand in how our BIS works!
