BMW Service Shock

Arent dealerships suppose to have insurance to protect the customer's car since its like their business trade?

Also dude if you dont sign it, then they dont have to provide you with a service. If they have to drive your car on like a hydrolic lift to go under it or for what ever reason they cant because you havent given them permission for move the car. Besides its a BMW dealership I dont think they will go clown around with your car on the road and smash it being stupid.

Also consumer act wont help you, because those are the terms and conditions they set they not forcing you to service the car there, i assume.

I accept they need to move the car, and drive it in order to service it. Surely it is not unreasonable to object to them saying I will pay for any damage caused to my car, no matter the cause, or who drove it.

I.e. I give them blanket permission to go use my car to do deliveries or let a sales man take it out as part of "testing" the car... and if they are talking on their phone and crash, somehow I must hold the risk of that?

If you paid for a maintenance plan, then why do it yourself? The issue here isn't the servicing, it's the clause which allows them to drive the **** out of your car without any real consequences.

Yea, because other cars NEVER need to be serviced and are NEVER at risk of being in an accident. I would worry about any car that I drove with all these idiots on the road. Whether the car costs R60,000 or R600,000, if you had any respect for your own property, you would worry about it.

Under South African law, you can not legislate out of gross negligence. ie signing the waiver will protect the dealership from accidental damage, fire, etc etc EXCEPT where such incidents should have reasonably been foreseen and prevented ( eg.leaving fuel lying around) or for GROSS negligence. eg mechanic racing.

The problem is these dealerships know that the little man on the street doesn't have the resources to fight them.

True, but people should remember that most law firms will take on instances like this on a no win no fee basis and most courts will award costs where the opposing party has been wilful in the action.
 
I make note of the mileage when I leave my car for a service. The dealership also normally takes down your mileage. You will know if they go any joy rides.
 
Just took my little polo in for it's 105k km service. And was also presented with two pages of CPA T&C's.. Skimmed it, but what are you supposed to do if you need your car serviced? Wait there the whole day to move it around for them?

I dunno. I'm not happy about the clauses, but realistically, what can you do?

If its negligence, you'll still have to fight them, whether you signed it or not - Just sign it
 
A few years back a VW mechanic took a friends Golf GTI-R for a "test run" and klapped a lady side on at 140km in a 60km zone killing her instantly.

A week back I took my wife's i10 in for a service and the guy refused to move the car one street over citing CPA laws.

I swear stealerships make this shyte up when it suits them.

Well yeah you do have a right to that. Though my question is why dont they have an insurance to protect your car while its under their care?

Also should something happen to your car say on delivering it to you, how would you go about proving its their fault in a court of law to negate their clause ?

Its also their right to put of Ts & Cs for their services, so first I think we would find out why this exists and how legal is it. Then how we can combat it should something happen to the car while in dealers care.

Has anyone been through this? it seems like this is handy information to have
 
If any dealership did this too me, you can be guaranteed I'd come back on the future for a test drive of one of their cars which wouldn't make it back in one piece!

That's awesome, except you agree to pay the R10k excess if you have an accident while taking a test drive.

They are effectively absolving themselves of any and all risk.

If I could only convince my clients to let me have free go with their property while I have it. Oh sorry, your MBP fell down the stairs... Woops

I've never had to do anything but hand over my drivers license before going for a test drive
