Bought a "new" house, huge issues.

That is starting to seem like a option for me.
 
Get someone in to estimate on all the repairs, look at it from the point of view that you will have to pay for everything...then decide if its worth it.
 
I would actually concur with everyone here...

If the transfer hasn't gone through, cancel the deal and walk away before you have to sink big money into the house to make it right.... That is money you will never see again, and money you won't be able to use to make the house better.

But seriously, I need to put emotions aside and think about this over the weekend.

Bottom line is I can fight this troll but in the end she is a poor, lonely, useless piece of excrement.

I am getting quotes to resolve the issues, I will take it from there. I don't believe the issues are so damning to cancel the deal and start over, that would be silly IMO.

If the house was falling down then yes maybe but all these issues can be fixed. The cost of putting all my stuff in storage, finding a place to rent, looking for another house, transfer costs and the list goes on. . I can fix the issues with this money.


BTW: that chest pain hasn't happened again. Holding thumbs :p
 
Good luck Grimspoon. Sounds like a nightmare. The way I see it you will end up paying almost all costs regardless as the seller clearly has nothing to pay. Even your lawyer getting a judgement would only give you a moral victory I suspect as you will still have paid the lawyer and she sounds like she has nothing to pay back. I think you are in the correct frame of mind now to look at what it will cost to fix this, and then decide rationally what you want to do. If its going to cost R50K+ to fix the place up perhaps buying another place could be cheaper.

I recently bought a new place (a year ago) and the place was in bad condition but at least we saw that up front and priced it in when we made our offer. What she did to you is just shocking.

It really is stressful to start looking again and having to be in temp accommodation (shudder, did that once - the next time I sold I put the money in a medium term investment, signed a 9 month rental with option to renew in 3 month increments and used the time to look at leisure - timing worked well)

From your opening description the issues sound relatively superficial - nothing that can't be fixed fairly easily - IF you can get the cost of the fixes (using your preferred builder) knocked off the purchase price you're sorted.

Just went to see my lawyer. He says I have a unbelievable strong case against this witch. I just need to add up the costs of fixing it myself opposed to taking her to the cleaners. He says she doesn't stand a chance.

You hit the nail on the head AfricanTech. I am getting quotes for the repairs and will insist this comes off the purchase price.

and didn't i tell you that in my post when i posted the link for you. trust me i was going to sell my house last november and started looking at houses. i couldn't believe what i was seeing and did my homework just by looking up stuff on the net. the word "voetstoets" is only good if you have disclosed every single defect in the house and the buyer accepts the offer to purchase as is. if you haven't disclosed every defect and it is later discovered, as a seller you will be held liable for costs.

you should be taking these issues to the bank then, as the bank is actually the seller. Previous owner should not be involved in my opinion.

The deal was done with the owner. So its actually not a repo. The bank simply aided with the sale, but in fact I should approach the bank as they want their money from the sale.
 
So how far are you with this whole issue? I know you are very good in procrastinating.

Well seen my lawyer, tallying up the costs, guy there today to assess some issues, got another guy coming tomorrow and then I take it from there.
 
U should be used to things breaking around you.....dont you drive an Alfa? :)
