Bought a "new" house, huge issues.

The lawyers are responsible because Transfer hasn't been effected yet if my understanding is correct.
 
Ps...sorry you have been having such a shiity time with your new home, I'm really hoping you start to feel at home soon and that all the crap was worth it.
 
Well 20 months after moving into my house, half the db board had a meltdown (looks like badly wired) and who knows what that's going to cost me now even though I have the compliance certificate from the previous owners... Ffs, I don't think there are many decent sellers out there anymore.

If it's negligence, you sue the electrical contractor who issued the compliance certificate. Have a Inspector come and inspect the electrical installation. Also talk to your insurance.

They are conveyancing lawyers, do you think I could report them? They are so rude to us, and we keep telling them, we are the client. We are paying you a lot of money and we are getting nothing but delays and bad attitude.

Yip R35k. They have the wrong readings and have thumb sucked a figure that they say we are liable for. We told them we are not paying it. We have taken the readings every week since we moved in AND we have a Job sheet from the council that clearly shows the error. Who the hell are the municipality to refuse to rectify the situation?

Well these idiots are taking no responsability. To make matters even worse the lawyer apparently only works Tuesday and Thursday so she is dragging balls on th is.

You'll get no where with the law society - I reported the attorneys on my purchase as they constantly messed me around. e.g.:
I specifically requested a electrical certificate in May 2009 because of all the computers I run at home - In September 2009 I received a letter from the attorneys stating that they had received the certificate, and all was in order. We took transfer in November 2009, and within the first week started picking up lots of electrical problems - I asked for a copy of the certificate. Turns out that it wasn't issued as stated in the letter from the attorneys as the seller didn't have money to do the repairs required. Suddenly the transfer attorneys said they were withholding money for the repairs. First time I was hearing this, and I doubt I would have heard it had I not queried for the certificate.

The law society found no problem with the firm saying they had the certificate when they didn't...that was just one issue.

Where do u get contact details for said inspector?
 
1. The transferring attorneys usually act on behalf of the Seller and not the Purchaser. You are not his client although you pay the costs. You will have to get a lawyer to represent you in the matter.

2. It is not the transferring attorney's duty to sort out your billing issue with the municipal council.

You need a lawyer who is prepared to fight 'dirty' on your behalf.

When you have someone who can start talking about penalties and suing, etc then you will get action.
 
So just an update for anyone who cares :p

My house finally transferred this week! Only a year later :rolleyes:


Now I am over the moon about this, but a new set of issues has arisen in the form of the electrical compliance. This electrician is beyond useless, he has left out some of the most obvious things for a compliance certificate to be issued namely:

Exposed wiring from light fittings
Lights outside not even working (he says it has been disconnected so its not his problem)
Lights tripping (had to come back and fix that)
1 plug point is not even screwed into the wall properly and is accessible by small childrens hands.


Now I am the ****ing moer in. What has he ignored to do that I can't even see. I think I am going to cut the crap and go straight the electrical compliance board and get them to come do an inspection. I heard from a very reliable source that this clown is no stranger to being in *** with the compliance board.

Congratulations - May you have many years of happiness there.

My advice, report the dude, small claims for you money, and then get another, reliable oke to fix everything

You paid occupational rent for a year? Surely thats not the norm.

Just bought my first house - also having some issues - hopefully my path will be easier than yours.

Fluck, I don't know what it is about fixer uppers, but why is it that houses hold themselves together for 10 years but the minute we buy and registration takes place, everything is falling apart!!! So damn annoying! ( and expensive).

We finally got out first municipal bill..6k which I didn't think was so bad...that's for 6 months so a lot less than anticipated.

Nah, we only paid for about for 6 months. We moved in when our house was sold about 6 months after we singed the OTP.

My advice is fight them on it. Go straight to the estate agent and make their lives unpleasant. Thats what I did and got most of it resolved but at a cost. Lawyers and time etc. End of the day you have to stick up for yourself and what you bought. Don't let people steam roll you.

Thanks Carol :) It has been a long hard road and we are still not entirely out of the woods, but getting there. The electrical compliance certificate was deemed null after I got the inspectors in, but I finally have my own electrician coming next week to fix everything which is for the estate agents account.
 
Thanks for the advice GrimSpoon - i'm a little fortunate that the conveyancing and transfer attorneys are the company i work for. So the plan is to get some lawyers involved as soon as im back at work.

Currently sitting with half a functional alarm system, a slimy green pool due to a busted pump/filter combo which happened 1 single solitary day after we moved in (go figure!)-ripped out fittings and fixtures and a few other minor issues.

I'm confident i'll get it sorted though - one way or another.

Good luck with your electrical problem. I have yet to get Gas and electric compliance certificates.
