Hi Guys
2 weeks ago we sent in a demand for a sgm, to try vote out the current trustees, to our portfolio manager, who is supposed to then send it on to these trustees.Instead over a week later this portfolio manager sends instructions on how to call a sgm etc.We already knew how to call an sgm and had sent in the proper pq percent and signatures and demanded to know why the demand was not sent on.Another week has gone and no response. In the meantime owners are getting threats from these trustees.Im pretty sure the portfolio manager hasn't got the right to prevent a sgm notice been sent to trustees and that it is the trustees who can then try invalidate the call if they think they have a case?

If you have the trustees details why not just send the notice directly to the trustees?

It not a matter of serving the notice on the current trustees, its a matter of serving the notice out to all owners (who's contact details the managing agent won't give). The current portfolio manager is clearly not impartial and is favouring the trustees over the regular owners.

Suggest you give a call to the head office of the managing agent and complaint about the conduct of the particular agent, threaten to send an email and copy all the managing companies directors and see how quicky you will get your SGM. Get someone well versed in the sectional titles act to give you a listing of the applicable clauses and arm yourselves with these.

Or you can go door to door and leave notices under the door for the AGM.

CSOS is also supposed to assist, write to them.

Yes Csos is one option i also heard about a EAAB supposed to deal with estate/managing agents but their reviews are in the toilet.

Csos wont really help. Csos is like the middle man in mediation.

Get as many owners together! Spread the word. Have your own sgm, take minutes

Who is the managing agent by the way?
