Check if any of the owners of the MA might be related to your troublesome trustees
The chair family tree is like a rats nest it breeds and breeds so anythings possible but I think its just friends she was also a estate agent for years.One of them also has the same surname as a previous managing agent of ours age wise its possible he is the guys son.

So us owners at our building want some truly awful trustees gone we have been trying to remove them for years now.We just called for another SGM to vote them out

But our Managing agent is refusing to announce it as they say we have failed to vote them out before so no point.

Just checking if anyone's ever had this happen and if us owners can go ahead and call this meeting without these managing agents involvement.I have emails for all the owners save one so can notify almost everyone and insist the MA notify the one I cannot.
We will have quorum and do have more than the 25 percent requirement to demand a meeting..
Hi , yes the owners can call a meeting on their own.
This is how it works.
If you have a signed petition with 25 present of owners signed the petition. The petition must state the reason eg. Removal of current trustees and election of a new board of trustees. Then you send it directly to the trustees or better hand deliver it to the chairperson and let him sign for it or have it delivered by courier. The trustees must then call a special SGM within 14 days. If they fail to call the SGM within 14 days the owners can then call the SGM. Just remember the trustees must call the meeting within 14 days but the actual date and time of the meeting could be at a later date as the notice period is also 14 days. So if you deliver the petition on the 1st of the month the trustees have to call the meeting within 14 days of receipt of the petition. If they agree to call a SGM the actual meeting can take place at a date and time decided on by the trustees. The owners will have control over the agenda but the chairperson of the trustees will chair the meeting.
So yes you can call a special SGM without involving the managing agent.
