Hi all
So us owners at our building want some truly awful trustees gone we have been trying to remove them for years now.We just called for another SGM to vote them out

But our Managing agent is refusing to announce it as they say we have failed to vote them out before so no point.

Just checking if anyone's ever had this happen and if us owners can go ahead and call this meeting without these managing agents involvement.I have emails for all the owners save one so can notify almost everyone and insist the MA notify the one I cannot.
We will have quorum and do have more than the 25 percent requirement to demand a meeting..

managing agent seems to be a problem as well, get rid of them while you at

the agent takes instructions from the principal, not the other way round
 
Had this happen. After the trustee was sent packing, the managing agent was sent packing next. The MA works for the owners, not the Trustees.

Sadly, there are barely MA that know the law, regarding if owners ask valid questions.

Example, any owner can ask for another owner’s information, within reason

Where i invest, its just said. “Zero info shared, its against the popi act”!

Yep same here Popi act this popi act that.But I have just been engaged in a heated email fight with this MA and mentioned some of the wrongdoings of these so called trustees.They then went and shared this email exchange with these "trustees" in secret and I got threatened and insulted by those morons.That seems to me a violation of the popi act on their part?I did not give them permission to share any of it.

Yep thats the plan.But got to get rid of these "trustees" first and they own multiple units so they have had minority rule going on for years.

Csos confirmed in writing, any owner can ask for information regarding any owner of the BC, within means! (No excuse to be given)

I just phoned csos to say I do not have contact details for one owner and that the MA will refuse to give me it.They said just to instruct the MA to forward it on and you have then done your due diligence.
 
Yep we have easily 40 percent of the requirement in Pq

If you are meeting the quorum requirements, but the MA is still refusing to schedule an SGM, refer your case to CSOS.

When I was a trustee, some owners tried to arrange an SGM for reasons I forget, they couldn't get a quorum, so we told them to take a flying leap. But, had the managed to achieve a quorum, the meeting would have had to go ahead.

Spoke to my mom who is an MA and she said if you have the signatures of 25% of the owners then the MA is obliged to arrange the SGM for you.

I had an issue with another owner lately. MA snd trustees didnt want to share personal information. I emailed csos, and confirmed trustees and MA are super wrong. Then I forwarded caos reply to them, information shared

Its against the law not to share owner info if needed if you are part of a BC. Its very simple

But I kept plugging away and they have caved.Heres the really stupid part.When I called for the Sgm they suddenly needed to hold the Agm that was due in January.So SGM scheduled for 2nd Agm the third

Well, then you technically don't need the SGM as all the business you wish to conduct can be done at the AGM. So not sure what they are hoping for. I'd keep the SGM date just in case they try something funny though

You need to find out which owners won't be there. Then get proxies from those owners that can't come.
A person (can be an owner or non-owner, or as the Sectional Titles act calls them: member or non-member of the scheme) can hold only 2 proxies. This gives an owner 3 votes, and a non-owner 2 votes.
You also need to get nomination forms filled out so you will need to rally the troops and get nominations for those who are prepared to stand as Trustees.
 
Still fuming about this trustee suddenly appearing on our email thread.Its possible this MA is bccing them in secret? or could just be it was forwarded to them.
I mentioned in the email thread how owner were threatened before every SGM but never said it was by these trustees although its logical it would be .wonder if that would provide an excuse for the right to forward the email on.
Would there be a way to tell if this email was forwarded?rather than them been bcc'ed in.

Hey man we have tried when counted in number we are 9 to 6 majority but we are always just a couple percentages shy when counted in PQ and that is how the majority of the votes are done.In the last decade only had 1 vote in number.Problem is the few votes they get are bought with favours and services I can prove it logically but don't have concrete proof and I have little faith in Csos.

No we do.In 2022 we announced we will be boycotting every meeting called by them It was pointless attending these meetings anyway.So breaking that boycott and attending the Agm and then been short on the vote would be a double blow.At least with the Sgm we will know if we don't have the votes and can skip the Agm..And then there's the principle they only called the Agm a week after we called for the Sgm and letting them and this MA get away with this would set a dangerous precedent IMO.
