Cancellation: HELP!

Just a note of caution,
I've heard that any company can put you on the credit bureau's black list if you fail to pay. Whether its justified or not, getting your name off the list has proven to be a huge pain for a lot of people.
 
ajax, it's much worse. Even if you're account is only handed over for collection, you've got trouble. Telkom messed up my account, I lodged a formal dispute, they told me it has been resolved by meanwhile they handed it over. I found that out four years later. Paid the account (it's cheaper than geting legal help), but I still had a bitch of a time getting my cellphone contract approved. My name keeps popping up on ITC checks, even though ITC swears they don't have me listed at all.

And what's to stop Sentech from doing this anyways when the contract expires and you stop the debit order?
The whole system is anti consumer if you ask me

Nothing, of course. Even if you prove that they were at fault, YOU are still screwed. As someone mentioned before on this forum or one of the ADSL ones, that's the problem with South Africa. There's absolutely no consumer protection.

I don't trust Sentech to stop debiting my account when the contract's expired after seeing how useless their accounts department is.

Agreed. Based just on that I am starting to cancel my conracts as well as my Clients that want out, and that would be all of them

Based on KOFFIE's post on the top of this page, methinx this is another consumer issue that bears investigation and follow-up. I would think that this is clearly a case of misrepresentation on the part of credit bureaux, if their records indicate to credit suppliers and service providers that you were at any stage in default, whether erroneously or not. It could even be construed as denial of some constitutional right or the other, perhaps. Any legal types out there who would care to comment? Anybody have any idea whether this has in fact been tested in court? Somewhat OT, I know, but very relevant to those who are endeavouring to cancel with Sucktech and end up on credit blacklists...

UPDATE: I've been bugging the **** out of the call centre up to now. They people there are actually very friendly now. It's sad that friendliness won't improve the service. I am also in contact with Clinton Smith about the cancellation. So currently no actual results but I can sense that they get that I want to cancel :) Everytime I call I make sure that they understand that I am not gonna pay the 70% thingy!!!! Any results from u? (nonroker, arf?)

Just got a call from one of the call centre guys. He told me that sentech will cancel the contract with no questions asked if it is a problem on their side (after reviewing my logs). If its something thats not their problem, then I can calncel but with the 70% "pay-through-your-ass"! He also told me that it would take about a week for them to process my logs. This means 2 things for me:

1.) I will give them a week (they actually have to the end of the month to cancel me) then I will start calling them everyday making problems for them!
2.) If they wont cancel me, then I'll make their lives hell. Everytime the speeds drops or I have a disconnect, tickets will be opened and waves will be made!

I know this will have no effect on the borg (sentech) itself but it'll make me feel better!

It is important to ensure that your cancellation letter states that you are cancelling because SENTECH is in breach of the contract. Thus you are laying the groundwork for legal action if they get difficult. Sometimes I think it also helps to make completely unreasonable demands (e.g. Full refund for the entire time you have had MW). It always helps to have some negotiation room.

Every time I call I state that this was not the service that was promised and what I signed up for. Hopefully that is enough.

koos, i would recommend that you get something in writing (send them a mail stating that your cancelling on the basis that the service is not what you paid for), or try and record the calls. At least that way, if push comes to shove then you have hard evidence to nail these b@st@rds with.

So they are going to check your logs to determine whether they are at fault or not? Oh come on! This is like asking the fox to determine whether foxes are responsible for the killing of chicken. Or getting the police to investigate police corruption. What are the criteria that they will use to decide it's their fault or not? How will they get that information out of their logs? Will you be able to see their logs, or must you just believe what they tell you? How do you know that they aren't lying or selectively choosing logs that supports their case and negates yours. We all know how absolutly 100% ethical and honest these people are. What an absolute farce!
 
This whole thread leaves me very worried, I must admit.

I thought my service had improved somewhat, until I tried streaming media again - one of the obvious uses of "broadband"

Winamp radio works with 28.8 streams for about 2minutes before dropping.
BBC Streaming news for about 3 seconds - that's at 34.5
I'm on a supposed 128 connection here.
Downloads have improved. Surfing is about the same as a good 56k modem connection. p2p is still pretty up and down - mostly crap.

I phoned some time back in connection with cancelling and it was very easy going - send a fax to so and so and take it from there.

Somehow, I don't think it's going to be that easy anymore.
 
logs? what? i thought you werent allowed to download. double standards.. if your log is "empty" then is that good or bad? what a fck up
 
Koosbeer, I put a cancellation ticket in at the beginning of september. I sent them a fax clearly stating that I am cancelling based on poor international bandwidth - sub standard to the package I had (256k) - I was barely getting 6KB/s. I stopped the debit order and phoned the helpdesk every second day until Clinton phoned me to say they will cancel the service on the 1st of October which they did. They still haven't contacted me to fetch the modem. I think it is going to get more difficult to cancel with sentech - thats why I got out as soon as possible. I will re-evaluate all the players in March next year and then decide which of the oversubsribed over-charged srvices I will join. [:)]

Everyone saw the "Sentech Response to ASASA and ISPA " thread? Does this mean I have stronger ground to cancel? I can say that I signed up for the BROADBAND 128 service and now they call it highspeed and not broadband? Please people... any comment?
