Cancelling a Lease Agreement

Our current lease agreement states 2 calendar months notice must be given if you want to cancel the lease.

We found a property that my wife really likes except the owner wants occupation 1 September.

Can we give a weeks notice to cancel our existing lease agreement? What are the consequences? I will probably loose my deposit. But what other consequences could there be?

Whether I leave end of this month or end of next month, I will still loose this.

Our big problem is the properties becoming available now are for 1 September and for 1 October.

Find a new tenant that can move in by the 1st?

Start with a conversation with the landlord, most people are rational. If it is an estate agent, I have found them to be more hardline.

I gave notice to leave 30 September. Looks like I'll be paying rent for 2 properties for September.

A few years ago I got away with cancelling a lease early. Luckily for me the lessor was understanding, just lost my deposit but I didn't mind.

Read the contract. The landlord can demand the 2 months payment. If your deposit doesn’t cover it. Then he can ask you for the balance. And if you don’t pay he can impair your record on Tpn.

According to the lease agreement we have to give 2 months notice. There is also a clause where early termination will cost me R500 from my deposit for advertising and getting a new tenant. If we get new tenants by end September, we get our deposit less R500 back.
