Car accident

Hi. I was involved in a car accident recently.

Car A hit me from behind , pushing my car onto Car B.

The driver (and his lawyer) of Car B called me up and says that he recently cancelled his insurance as he was about to sell his car (not sure how true this is)

He then obtained quotes to repair the car from 2 panelbeaters and sent these to me, I think with the expectation that I will cover the costs.

What steps do I have to follow? It is not my fault that the accident took place and not my fault that the driver of Car B cancelled his insurance policy. Please advise
 
I assume you were stationary at the time.

Did you leave a sufficient gap between you and car B? Was your handbrake up at the time? Was your handbrake in good working condition?

I only ask the questions to establish whether there is any negligence on your part, for which you could be held partially liable.

If the answer to all three questions is no, tell them to claim from the driver of Car A.

If you answer yes to any, I would still tell them to claim from the driver of Car A but you would be willing to contibute a sufficient percentage of the costs.

DISCLAIMER: This assumes you have no insurance. If you have insurance, they will handle all claims and you must not admit liablity or fault in any way.

Do you have insurance? If you do, stop talking to them and get your insurance people to deal with it -- His insurance or lack there-of has nothing to do with you.

Otherwise, can't really say, but good luck.
 
I was driving on the M1 and due to sudden traffic, I slowed down sufficiently and was almost stationary (so handbrake was not up). Driver B even told me and the policeman that he saw (through his mirror) that I had slowed down. The police were there at the scene of the accident and took down details of the accident and the drivers. Driver A even admitted that it was his mistake
 
I do have insurance as well

Then do not get involved: You pay your insurance for a reason, let them do their work - If they guy phones again, respectfully get him to phone your insurance and deal with them.
 
guy rammed me a couple of months ago...his daddy's insurance called me and i just referred them to my insurance. havent heard anything since...
 
Car B has no claim on car A. he needs to claim from your insurance, then if it is car A's fault your insurance will try to recover from car A's insurance.

what kind of idiot cancels his insurance?
 
I was just concerned that Driver B will go the legal route i.e issue a summons etc ; but seeing that my insurance company will handle all matters from a legal point of view; I am at ease now :)

Yeah just don't get involved anymore.

Even if he does, forward all correspondance to your insurance and avoid getting involved.
 
yea stay out of it but if your forced into getting involved request proof that guy cancelled his insurance and verify it with his "previous" insurance company, i think he is taking a chance... Just refer him to your insurance company and they will quickly tell the guy if he has a claim or not...
 
Just make sure you know the outcome regarding the claim. My brother had an accident and left it to his insurance to sort out with the other party and the insurance company didn't do their job properly and my brother was wrongfully blacklisted.

say you are car A, and are waiting at a robot and Car C (right at the back) hits car B and car B hits into you. The sequence goes to claim from who hit you, then his insurance must claim from the responsible party. And generally what would happen is you would actually claim from your insurance and then they recover from the other. So yes you get screwed with excess etc that you will 99% never see again.
 
The guy who crashed into the back of you is responsible for all damages, including the guy you got pushed into. You are automatically in the wrong if you rear end someone, regardless of the circumstances, or has the law changed?
