Car Accident

If you have insurance on your own car then why would you care if the other guy does or doesn't? :confused:

I've had 2 accidents over the last 5 years, and due to the other knobs not having insurance I've had to pay our nearly R10k in excess fees that I'll never see again, for someone elses bloody cockup.

Even if one guy has insurance - he still has to pay the excess that he will never see again. At least, when an insured driver hits you, there is a way to claim the excess back from there. With a lot less hassle.

Ok, fair enough.. but imho thats more of a problem with insurance companies that should be fixed rather than trying to force every driver to have insurance. I.e., excess should be scrapped if the accident wasn't your fault - the insurance company can chase the other guy around for the money if they want, that's what they're paid for. :p

I actually thought it worked like this anyway, but then the only accident I've experienced recently didn't involve anyone else anyway (and excess was minimal).
 
That's not how it works.

You insurer normally covers you up to an X amount.
For example I am covered up to R5 million. So if I hit a Ferrari my insurer will cover all the repairs to his car. I will pay an excess (Normally a couple of grand) and that would be the end of the matter. (I may also be liable for the other guy's excess - not sure on that, though? )
This is also covered on 3rd party, Fire and Theft. That is the lowest form of insurance and normal less than R300 a month for. It's stupid not to have at least that cover on yourself.

He was assuming you are not insured. You're screwed for life essentially.

Can't you take them to court over those funds though? Attach assets?
 
I would just like some advice.

A car was driving in the 4th (Lane) had to suddenly break for the car infront and then the car spinned into the 2nd lane (My lane) and hit me on the right hand side.

Is the accident the other cars fault and will I be able to take her to court if the she doesn't wane pay? None of us has insurance.

That the other car had to swerve across lanes to avoid accident indicates he/she was not at a safe following distance and alert to begin with thus putting every one else at risk. The situation could possibly have been avoided but due to negligence was not. That's about all you have to work with. But recommend you learn for not having insurance.
 
I've been told by the insurance attorneys that unless someone admits to it being their fault, that it is just assumed a mutual fault and everyone pays up until proven otherwise.

Anyway, I will just come out and say it - it is absolutely reckless to not have insurance and drive on public roads. It should be law that you have to have insurance to drive on public roads. I despise all you *******s who drive on public roads without insurance (yes, I consider it an ******* offence).

This rant actually made me more angry just thinking about it.
 
...None of us has insurance...
