Friend got caught with bandwidth theft the other day. All he got was a R1500 fine.

Discuss!

Theft is still theft, no matter what got stolen.

Telkom really should increase their caps and decrease their pricing levels - this will act as a better deterrent than a stiff fine.
 
Absolutely no need that warrants the theft of bandwidth - especially if its for downloading of illegal material etc. Now i dont condone the use of illegal software or watching illegally copied movies, downloading them with other peoples bandwidth i have a problem with. Especially if you cap that account leaving the owner to top it up again.
Tell your friend its time to grow up and stop stealing.

Just by the way - that's a lame first post. You don't just say, "The sun is shining." ... ... ... "Discuss!!!!". Thats just stupid imho. Give the post some meat man - introduce an argument, ask a question or comment on how stupid your friend is etc etc so that we Can discuss something at least. Say something like ... "My friend got nailed by the police for stealing bandwidth - my bandwidth - that I used on his line - and reported months ago. :o What to do?"

Cut me some slack, I was under the influence and look at the time, DEADtired. -.-

He got a call from some Cape Town cops, they told him they are coming the next day, thus he had time to delete all evidence.

They arrived, just calmly asked who it was, he said he had no idea, might have been his friends that had a LAN there. The guy gave him the R1500 fine, and the Policeman said he has to take his 'router' until he pays the fine. The Policeman wanted to take a random hard-drive that laid around since he thought it was the router. My friend had some stuff on the HD he needed so he corrected the cop.

He has been stealing for more than a year, easily more than R1500 a month. The search warrant stated the name and the account of the guy that caught him in LAST JULY. That's when it was reported, action was taken now. Search warrant also stated the cop has to come at night and raid all Hard drives/Skype phones etc. Instead he came at daytime expected, and almost raided a hard drive.

And Moklet, "So you've got a thief for a friend ????". Hahahah, gotta love these people. I can have a Circus Ringmaster for a friend, does it make me one? No, <deleted by="ic" reason="personal attack"/>.

Surely that should read : "An ex-friend got caught...", or "Some piece of **** I know got caught..."? I'm all for loyality, but criminals don't deserve any.
 
This sounds very fishy to me, surely Ensiferum's friend would need to appear in court and be found guilty in court before being ordered to pay a fine?

As for an appropriate punishment, a fine on its own is not sufficient, the ADSL line used to commit the crime should also be permanently disconnected if the line is in the name of the person found guilty, or the person whose name the line is in should also be required to pay a separate fine or have their line permanently disconnected.
 
Sending this situation to court is time consuming and will end up costing more than just a simple fine. More work for everyone.
The account can be traced directly to the port being used, which is linked to actually residency using that port. Proof is there that the crime was committed.
Owner must just pay the fine and hopefully learn the lesson, they are actually lucky there arent any charges processed against them. Cutting off the line could cause problems.

According to Ensiferum the actual crime was committed last July and has only now been dealt with, I suppose it would take longer through the courts, but why was it not dealt with sooner outside of the courts?

I'm going to PM Dominic and ask him for his expert legal opinion.
