Coffin assault trial

What makes you think she didn't know that?

Saw how she handled the trial and her judgment and sentencing procedures too. She has very little legal knowledge and makes me lean towards seeing her as uneducated and probably an AA appointment to fill the post. That said, her qualifications, experience and education should probably be investigated. The fact that she is 100% certain that no other court would ever come to another conclusion is evident that she thought this may protect her from further legal review. She was wrong. The appeal will be allowed and these guys stand a good chance of probably walking out with a suspended sentence.

Fair

What these guys did was wrong, so they have to face some sort of justice. I hope they get a suspended sentence with LOADS of community work, if the appeal is successful of course!

See the post above yours? What is your legal background exactly?

+1, would be interested to know too..

Just to clarify,

You both missed the fact that she messed up the sentencing? She suspended part of the sentence for 8 years which can not be done.
Does this sound like a qualified Judge who made such a stupid error? Coupled with an error sending them to jail for 23 and 29 years?

Come now guys... really? :D

Fair enough, missed that part about the technical errors - would be interested to hear a legal opinion on how she handled the rest of the trial.

How is that messing up the sentencing and why can't part of the sentence be suspended for 8 years?

She is obviously qualified or she wouldn't be in that position.
All I could find out is that she was admitted as an attorney in June 1998 and served as deputy president of the Law Society of the Northern Provinces from 2008 to 2009 and had acted as a judge in the North and South Gauteng High Court periodically in 2011 and 2013 before being appointed on recommendation of the JSC.
I'm pretty sure she is far more qualified than you. Believe it or not, the majority of people support her judgement.

When she sentenced them, she suspended their sentences to eight years, but according to the Criminal Procedure Act, the maximum time you can suspend any sentence is five years.

The second error was more significant, as the judge, after sentencing, wrote on the warrants for their incarceration that they had received 23 and 27 years respectively, in stead of 11 and 14 years. The warrants was also accordingly signed by the judge.

The significance of this was that they pair had to go to a different section of the jail, as they received sentences of more than 20 years. In terms of the warrants they had to be incarcerated with inmates who received similar sentences.
