Coffin case transferred to high court

Middelburg - The case against two men who allegedly forced Victor Mlotshwa into a coffin and threatened to pour petrol over him, was transferred to the High Court in Delmas on Monday.

Theo Jackson and Willem Oosthuizen appeared in the Middelburg Regional Court in Mpumalanga on Monday morning.

They face charges of kidnapping and assault with intent to do grievous bodily harm.

The alleged assault took place at the JM de Beer Boerdery, near the Komati power station in Mpumalanga.

On August 17, 2016 Mlotshwa noticed two Land Cruisers following him, investigating officer Constable Dimakatso Bahula previously told the court.

It was reported that the SUVs stopped and two men are said to have assaulted Mlotshwa and kicked him, without any explanation.

In a 20-second video of the incident, which was posted on YouTube, one man, speaking in Afrikaans, forces Mlotshwa into a coffin and threatens to pour petrol on him.

The trial will start on July 31 to August 10.

They both remain in custody.

Coffin assault duo granted bail

Middelburg – The Middelburg Magistrate's Court has granted bail to two men who allegedly forced Victor Mlotshwa into a coffin and threatened to pour petrol over him.

Magistrate Jongilizwe Dumehleli said the Director of Public Prosecution's delay in terms of the trial had infringed upon the rights of the accused.

Theo Jackson and Willem Oosthuizen were on Friday granted bail of R1 000 each after reapplying for bail. Earlier Advocate Johan van Wyk, for the accused, argued that the pair should be released on bail as they would not interfere with investigations "because they are finalised".

"At this stage, there is no indication of any likelihood that the accused won't stand trial," he said.

But prosecutor Robert Molokoane said there were no new facts supporting the new bail application, adding that the defence was reflecting on the same issues raised during the first application.

They previously abandoned their bail bid, but then asked the court to grant them bail. Their bail application was denied at the time.

The court gallery was packed with members of the public and journalists. From the first day the matter was heard in court, political parties have staged protests outside the venue. However, the demonstrations have since come to a complete halt.

Death threats

The pair face charges of kidnapping, assault with intent to do grievous bodily harm, attempted murder and possession of an illegal firearm. In their affidavits, read out in court by Van Wyk, the men said they had received death threats since they were arrested.

They also said they had witnessed several attacks by "hardened criminals" on other inmates.

"We have received death threats while incarcerated in prison, and the prison authorities had to move some prisoners to other sections in order to keep us safe."

They also said since the State's investigations were finalised they would not interfere with witnesses. In his affidavit, Oosthuizen told the court that his wife and two minor children depended on handouts to support themselves.

He said he had arranged to move from Middelburg to Potchefstroom where he believed he would be safe. Meanwhile, Jackson said his wife had sold their livestock as well as "my expensive specially-bred bloodhounds, partly because she did not earn enough to feed them and partly to earn extra money to support our three kids".

During their appearance in 2016, the pair told the court they had merely wanted to teach Mlotshwa a lesson. They claimed their actions were "negligible" and that they did not mean any harm.

First State witness takes the stand in 'coffin duo' trial

Delmas - Farm owner Johannes Mattheus de Beer who employed Theo Jackson, an accused in the coffin case, testified that the coffin in which Victor Mlotshwa was forced into was purchased by his father to be used by employees to bury their family members.

The High Court sitting in the Delmas Magistrate's Court in Mpumalanga on Monday heard that De Beer's father bought two coffins, one of which was used by an employee to bury a deceased relative and the other which was stored away and subsequently used to force Mlotshwa in.

De Beer said he first learnt about the incident which occurred in August 2016 via social media and the news. He said he told Jackson that he should hand himself over.

De Beer also testified that he told Jackson the coffin was now his as he wanted nothing to do with it. He also said he was heart-sore when he learnt about what happened to Mlotshwa.

Mlotshwa was allegedly walking on a footpath through De Beer's farm when he was confronted by accused Willem Oosthuizen who stopped him and told Mlotshwa that he didn't want a "k***" on his farm.

Charges

De Beer testified that he knew about the footpath, that people had used the footpath since he bought the farm and that he did not approve of the use of the footpath as it brought about theft.

He said, however, that not all people using the footpath were confronted.

Earlier on Monday, both pleaded not guilty to all charges and offer certain admissions which included that they both allege Mlotshwa was found trespassing and in possession of suspected stolen property identified as copper cable.

The charges that both accused face include possessing an unlicensed firearm, kidnapping, intimidation, defeating the ends of justice, assault with the intent to do grievous bodily harm, and attempted murder.

Both accused, who are foremen on different farms in Middelburg, said after they arrested Mlotshwa they informed him that they would take him to the police.

Mlotshwa then allegedly threatened to burn down the farms crops and murder the wives and children of both accused.

Both accused made the admission that this was when they decided to not take Mlotshwa to the police and instead took him to a remote area in order to "convince" Mlotshwa not to go through with the threats.

This is where they admit that they forced him into a coffin and threatened him.

The trial continues.

Duo allege coffin was used frequently to 'scare' mielie thieves

Delmas - The coffin that Victor Mlotshwa was forced into was allegedly used frequently as a means to scare people from stealing mielies on the farm, the High Court in Delmas has heard.

The advocates for the two accused, Theo Jackson and Willem Oosthuizen, argued that the coffin had been used before by farm owner Johannes de Beer.

De Beer, who employed Jackson, took the stand on Monday.

During cross examination, advocate Wayne Gibbs for Oosthuizen said the very reason that Oosthuizen had thought of using the coffin after apprehending Mlotshwa was because De Beer had told him about an occasion when he had used it to scare people who were stealing mielies on the farm.

"He thought it would be opportune to scare Mlotshwa to not steal and not carry out threats," Gibbs said.

De Beer confirmed that he and Oosthuizen had caught people who were taking mielies and that Oosthuizen had left De Beer with those that had been apprehended. He, however, denied the use of the coffin.

De Beer said he told them that he wouldn't open a case if they told him who was buying the mielies.

Advocate Org Basson for Jackson also put it to De Beer that it was common knowledge that the coffin had been used before to scare people on the farm. De Beer again vehemently denied this.

De Beer did, however, admit that he had lied under oath when making his affidavit to the police concerning where the coffin was.

Earlier on Monday while being cross examined by the state, De Beer said he had told Jackson that the coffin belonged to him now and that he wanted nothing to do with it.

But, when under cross examination by the defence, he then admitted that he had told Jackson to get rid of it.
The defence pointed out that he had said this before he made his affidavit to the police saying that, as far as he knew, the coffin was in storage.

Both accused have pleaded not guilty to all the charges and have offered certain admissions which include that they both allege Mlotshwa was found trespassing and in possession of suspected stolen property, identified as copper cable.

State's second witness claims to also have been assaulted by coffin duo

Middelburg - A man who claims to have also been assaulted by the two men who forced Victor Mlotshwa into a coffin told the High Court sitting in the Middelburg Magistrate's Court on Tuesday that they kicked him and called him a k****r.

Delton Sithole was testifying on the second day of the trial where Theo Jackson and Willem Oosthuizen are facing charges of kidnapping, assault with intent to do grievous bodily harm, attempted murder and possession of an illegal firearm.

They were granted R1000 bail each on July 14 after reapplying for bail.

Dressed in suits, both Oosthuizen and Jackson looked calm during proceedings.

The court gallery was packed with members of the public, some clad in various political regalia.

Testifying in Xitsonga, Sithole told the court that the pair kicked him all over his body.

Sithole said on August 17, 2016 he was walking back to 'Big House' squatter camp when one of the accused - Oosthuizen, who was driving a bakkie, approached and asked him what he was doing on the farm.

Sithole said he told Oosthuizen that he was just passing by.

He said Oosthuizen got out of the bakkie, confronted him and grabbed him by his wrists.

He then went to his bakkie and took out a firearm, he said.

Sithole said when he ran away, he came across Jackson who ordered him to get into the bakkie.

He said when he opened the passenger door, Jackson said, "He cannot sit next to a k****r".

Asked by prosecutor Robert Molokoane how he felt when he was allegedly called a k****r, Sithole said, "I felt degraded".

He also testified that the two assaulted him for a long while.

"My legs were hurt. In the process of this assault, I injured my tongue."

He said while he was being kicked, he overheard the pair saying "another k****r was on the farm," referring to Mlotshwa.

Sithole said he went to the squatter camp and told the community that "the whites had kidnapped Mlotshwa".

He said he witnessed Mlotshwa's incident unfolding but he didn't see the entire scene.

But Wayne Gibbs for Oosthuizen said Sithole was not being truthful in his testimony.

"He [Oosthuizen] doesn't know you at all. The incident is not true at all," Gibbs said.

He said according to his client, the incident relating to Mlotshwa happened on September 7 and not August 17.

On Tuesday morning, Judge Mogopotje Mphahlele who is presiding over the case conducted an inspection-in-loco along with the accused, prosecutor and investigating officer.

The alleged assault took place at the JM de Beer Boerdery, near the Komati power station in Mpumalanga.

Both the accused and Mlotshwa were asked to point out several places, including where the assault had allegedly taken place. There were several discrepancies in the pointing out of some of the locations.

The trial continues with Mlotshwa expected to take the stand on Wednesday.

Yeah. Right. I'm way past the point of believing a story like this.

I've been accused to many times of calling people h******* or k******* it's not even a surprise anymore when such an allegation surfaces.
 
How is this witness allowed to testify in a court of law when there is no evidence to support any of his claims. It's all hearsay and the only intention it could have is character assassination. If I was the lawyer I would have the witness declared hostile and then get to whoever is behind this fabrication. The only real evidence is the testimony from the accused in that they used the coffin to scare Mlotshwa. That is more than enough evidence for a conviction. But this side show is farcical.

Middelburg – Emotional testimony from the man who was forced into a coffin on a Middelburg farm forced Judge Segopotje Mphahlele to adjourn the matter after Victor Mlotshwa broke down when he took the stand.

Upon seeing her son break down on what was the third day of the trial in the High Court sitting in the Middleburg Magistrate's court on Wednesday, Mlotshwa's mother, Lonia, who is also expected to testify, also started to weep.

Theo Jackson and Willem Oosthuizen are facing charges of kidnapping, assault with intent to do grievous bodily harm, attempted murder and possession of an illegal firearm.

There were also heated reactions from the public as Mlotshwa wept as he recalled how the two men had forced him into a coffin and allegedly threatened to pour petrol over him.

Some members of the public could be heard threatening violence, saying the accused did not show any remorse.

"God will punish them," one said.

Upon seeing her son weeping, Mlotshwa's mother said, "What are you doing to him? What are you doing to him?" She was comforted by members of the public.

Earlier, Mlotshwa gave detailed testimony on how he was assaulted by the pair on August 17.

'I was scared, shivering and crying'

He said his mother had sent him to Middelburg to buy groceries when he came across a bakkie.

He said he used a foot path as a way to get to Middelburg faster.

Mlotshwa said Jackson approached him while driving a bakkie and he noticed that he was not in a good mood.

When he tried to run, he noticed another vehicle which was driven by Oosthuizen coming straight towards him, he said.

He told the court that the two chased after him until he lost strength. He said without saying anything to him, the accused assaulted him.

The pair tied his hands with cable ties, and also tied him to one of the bakkies, he said.

He told the court that he was kicked many times and he struggled to stand.

"The situation was painful. I was scared, shivering and crying," Mlotshwa said.

He said one of the accused forced him into the coffin. They also said they would shoot him if he ran, the court heard.

"I was in a difficult situation and I pleaded with them not to do what they wanted to do.

"I was under the impression that they wanted to kill me. I just want to say the situation was painful."

Prosecutor Robert Molokoane asked the court to adjourn the matter to Thursday due to safety reasons following threats made by the public in relation to the accused.

He said 20 police officers would be deployed in order to keep watch.

Another alleged victim

The court also heard testimony from Delton Sithole, who claims to have also been assaulted by the pair. Sithole said they had also kicked him and called him a k****r.

He also told the court that since the accused were released on bail in July, he fears they would come after him.

Sithole was previously asked by Molokoane how he felt when he was allegedly called a k****r. He said, "I felt degraded."

He also testified that the two assaulted him for a long while, apparently on the same day as Mlotshwa.

"My legs were hurt. In the process of this assault, I injured my tongue."

But both the accused denied knowing him. They claimed that the incident relating to Mlotshwa happened on September 7 and not on August 17 as Sithole had testified.

Advocate Org Basson for Jackson said Sithole’s version of events was made up.

Basson put it to Sithole that he made a statement to the police because he wanted to support Mlotshwa.

Middelburg - Victor Mlotshwa's version that he was assaulted viciously by the two men who forced him into a coffin is not true, the High Court sitting in the Middelburg Magistrate's Court heard on Thursday.

Wayne Gibbs for Willem Oosthuizen argued during the fourth day of the trial that photos taken on the day of the incident did not depict any injuries.

Theo Jackson and Oosthuizen are facing charges of kidnapping, assault with intent to do grievous bodily harm, attempted murder and possession of an illegal firearm.

"Why would someone take a photo or video of someone they assaulted viciously?" he asked Mlotshwa.

"The accused would argue that they never beat you or kicked you. They only put you in the coffin and stepped on the lid," he said.

Gibbs said on that day, the accused took photos and video to "show what truly happened" to avoid being accused at a later stage.

Gibbs also said the reason why the accused put Mlotshwa in the coffin and threatened him with a snake was because he was allegedly caught in possession of stolen cables.

When the accused said they would take him to the police, Mlotshwa threatened to kill their wives and kids, Gibbs said.

"I know nothing about this. I don't have knowledge of those threats," Mlotshwa replied.

Gibbs said Oosthuizen took photographs of Mlotshwa after the incident.

"He didn't have any injuries on him," he said.

But Mlotshwa said, "I got out of the coffin - I don't believe there was enough time to take a photo as I was running.

"In order to scare you off and make sure he doesn't carry out his threats that is why they placed you in the coffin and made the threats," Gibbs argued

Earlier on the State presented a two minute long video in which the pair asked Mlotshwa if he wanted to die slow or fast.

In the video clip, one of the men says, "Jy praat *** [You're talking ****]," while questioning Mlotshwa about alleged stolen cables.

"Please don't kill me," Mlotshwa pleads with the men.

"You are killing my farm, why can't we kill you?" replied one of the men.

While the video played, Mlotshwa looked down, some members of the community wept, while others walked out of the court.

They were released on bail in July.

In the video clip, one of the men says: "Jy praat kaak [You're talking ****]", while questioning Mlotshwa about alleged stolen cables.

"Please don't kill me," Mlotshwa pleads with the men.

"You are killing my farm, why can't we kill you," replied one of the men.

While the video played, Mlotshwa looked down, some members of the community wept, while others walked out of the court.

I am by no means condoning what was done but if caught stealing in Mamelodi, Alex, Soweto he would have most probably been killed by a mob.

Just putting that out there.

This whole issue is just pathetic form the start to the end. The Judge could have sorted all this out in one hearing in a morning.

Judge to the "victim": Did you steal anything on the farm?

"Victim": "Yes your honour"

J: "Were you caught?"
V: "Yes your honour"

Judge to the Accused: " Did you catch the thief in the act"
Acc: "Yes your honour"
J: Did you take the law into your own hands?
Acc: Yes your honour
J: did you force the victim into a coffin and threaten to burn him?
Acc: Yes your honour.

J: I find the victim guilty of theft and hereby sentence him to xx days/months years in jail.
J: I find the Acc guilty of taking the law into their own hands, etec, etc.
J I find them guilty as charged and sentenced to xx days/months/years in jail.

Case closed. lets go for lunch.

Instead the whole issue is turned into a feeding frenzy of BS.


No one can make light of theft and no one can possibly condone the actions of the accused. What is the problem?
