Oosthuizen and Jackson were found guilty of the attempted murder of Mlotshwa.

The judge said that for an accused to be declared guilty of such a crime is if “he unlawfully engages in conduct that is not merely preparatory but has reached at least the commencement of the intended crime”.

Mphahlele further said the conduct of the accused at the scene is evidence of an intention to murder.

“Their conduct‚ if persisted with‚ could have led at the death of Mlotshwa.”

That just because they voluntarily withdrew does not mean the two men did not intend to commit the murder.

This will get thrown out on appeal, hopefully along with the judge in question.
 
I haven't followed this at all, but that this is on The Guardian's UK front page is disgusting from pretty much every angle.
 
Using this as a precedent, can you imagine what the farm murderers / torturers / rapists would be sentenced to if they were stupid enough to record themselves?

Of course I can imagine that, although I don't know what precedent are you talking about regarding this particular case? they were found guilty of a crime, not yet sentenced.

Pretty much the same as that boy beating up the girl at school. He could have broken her neck. Charge him with attempted murder.
 
I just want to know if I can carry my 6m extension cord with me, whip some dip**** round the head with it a few times and make them bleed profusely, and not have to worry about the police and stuff with murder and this nonesense.

Or beat the be-daylights out of a woman at a pub, if she offends me in anyway or fashion, and have the peace of mind to just walk away regardless.


Again, i care nothing for these okes in this case, and what they did to another human being is completely wrong and unforgivable.

I suppose what I am asking about is consistency?
