Compulsory e-tag - or lose your drivers licence

so how did they manage to build it before realizing that it will be unconstitutional and probably illegal?

Because they don't give a **** about trivialities like the law and the constitution when it comes to lining their pockets.

3. An employee appointed in terms of regulation 2(2)(a) may, subject to the Act or
any other law may-
( a) demand from any person immediately to produce a licence. operating licence
permit or any other document or authorisation authorising him or her to drive
or operate a motor vehicle, and to produce any other document or tag which
he or she is required to have in respect of any motor vehicle in terms of the
Act or these Regulations
, or the regulations on the exemption from payment
of toll promulgated in terms of the Act, or any like document issued by a
competent authority outside the Republic, and question any person in relation to
any such tag, document or equipment;

What I won't see in this document ( which is going to raise all hell ) is where it says that tags will be compulsory ?

:wtf:

Section 3(g). : at any time enter any motor vehicle and inspect such vehicle and any electronic device installed therein for the purpose of toll collection?!?!?!

Are the mental, I will not allow some random "peace officer" to enter my vehicle under ANY circumstances what so bloody ever.

How will they deal with people from other provinces and neighboring countries? Will they be forced to by a prepaid e-tag for the duration of their visit?

The could have said cops, metro police - so what/who are 'peace officers' ?

An officer of the peace, is an officer appointed in terms of the Criminal Procedure Act. They include Metro cops, SAPS, etc.

So basically this is giving a private company the right to create their own police force?... I really don't see this standing up to even the vague scrutiny in the ConCourt.

Let's start a counter force. I know a lot of guys that does not like the traffic police

I asked the same question in another thread, I'd imagine when it captures your number plate they get the information from the eNatis system and send you a bill. Not sure about international cars, good question though, you get a lot of nice imports which aren't allowed to be registered in the country. A way of bypassing this system would be to buy some vacant land in one of our neighbouring countries and register the cars there.

Technically you should get a day pass. But I don't think they'll even bother with foreign registered cars, though you could get in trouble if caught speeding or violating other road traffic rules by the real cops. Foreign cars are required to pay the fine right away or go to jail and their fines are higher than for locals.

Correct. And this is on top of the Officers that the Road Traffic Management Corporation are ALSO appointing as National Traffic Officers.

So we will have ....

SAPS
Metro Police
Gauteng Traffic Police
National Traffic Police
SANRAL e-toll Police

Welcome to the Police State.

and the criminals are smiling. With our crime stats you would think they would train more of the crime fighting cops.

Technically you should get a day pass.

Only if you want the "discount", you are not obliged to get a day pass

To whom must they pay the fine?

Do you have a source for this?

Foreigners have no other way than a prepaid tag for settling their toll fees.

There's a guy who used to drive a Swazi registered car and he told me that. And a second guy with a foreign driver's license told me the same.

True, but nobody said they must have a day pass/prepaid tag.

As far as I know it is not law, the cops are just taking them for a ride.

the laughable bit about it is they are having these sanral cop employees sworn in as peace officers, yet all they require to get the job is a diploma from SANRAL if they are going to be the new cop force for SANRAL

and if you are going to process the documentation you only require a training course as approved by the CEO of SANRAL.

LOL can just see how many fckups there are gonna be in the accounts office with this.

The criminals are smiling... because they just got jobs with SANRAL as peace officers! :D
