Contract expiry / termination queries

MTN allows you to upgrade in month 20 if I am not mistaken. You then have to finish 4 months of your current contract, and then 24 months of the new contract to have your contract expired.

You will be eligable for upgrade 24 months after you upgraded though, i.e. month 20 of the new contract.

No, you don't understand properly. My question is: Why, after my contract has expired, do I still have to pay R217 for R150 airtime.
Surely the phone part should fall away and then I pay monthly ONLY for airtime.

Because you signed an "Airtime Agreement", not a cell phone agreement... The cell phone is just subsidised and therefore you are locked in for 24 months. Thereafter you just get the airtime and if you use it without cancelling you pay for it. You are, of course, entitled to another phone and another 24 month lock in.

marco, we get all that, but, you should have canceled the auto-renewing contract that you signed and switched to one that matches your requirements.
Yes, we know that they're charging you at the rate that actually includes a phone.
Yes, it is an underhanded means of taking more money from you that they are by value not entitled to take because the phone is no longer included.

No, there is absolutely nothing that can be done to protect you from this sort of theft, not even the brand new customer protection act has a section that deals with this kind of daylight robbery. If more customers refused to sign a contract that continues automatically, then perhaps we'd get somewhere, but they just keep on signing them.

At last, someone with brains. The contract does state that it is a 2 part contract in one. When the phone part expires, then the airtime or service part is still payable until a written notice is received to stop the monthly deductions. So after 24 months, you should ONLY pay for airtime.

You forget about the mandatory phone upgrade? Which is always available to you even if you don't upgrade? ;) And I'd like to see you you to win this one is any court.

Sloot, just watch me. You don't seem to understand the law. Nowadays the law is on the consumer's side. Even the basic Common Law, never mind the Consumer protection Act will protect me on this one.
I don't want to upgrade as the phone is my daughter's and she left for the UK permanently.

Why didn't you just give notice and terminate the contract?

I can't as the phone is a third party contract and the signee has left Cape town and I have no contact with him anymore. The stop order is on my name. Only he can give notice.

28 months and still charged.

My contract has ended and I am still charged R217.00 for R150.00 airtime. Will have to have it reversed at the bank tomorrow. WTF, it has been 28 months and still paying this??

No I don't , but why should I pay R217 for R150 airtime????

Been like this since forever. You need to give them a month's notice ... all in your contract. Not cool, I know.

Hi

Once the contract reaches 24 months it continues but defaults to the normal subscription on the package. For example if you initially signed up for a 24 month contract at a subscription of R 200 for R150 worth of airtime on a promotion. The original price on that contract is in fact R220. Thus when the 24 months are up the promo is over and it will default back to R220. Hence you see the increased subscription in month 25. Note that this will not always be the case. It all depends if the contract you took was a promo for that price plan or not.

Regards
DD

Cancelled my only contract with MTN - this airtime buying at a premium just never worked for me - back to VC on that contract.

29 Months still charging.

I have just received another account of R217.00 for R150.00 airtime for my account that expired months ago. I don't need this damn phone. How do I stop it?
