Court Case for Speeding

I need a bit of advice here from anyone that has been in the same situation. I was stopped in a Road Block and they threatened me with arrest.

Firstly I am shocked that I have a court case against my name as I have heard nothing of it. Looking on Paycity.co.za it appears it was for going over 80kmph in a 40kmph zone. However I have received no Summons or notification for this. I don't want to be pulled over again with my family in the car etc. etc. I want to sort it out so that I don't need to do U-turns when I think there might be a road block ahead.

The "kind" Officer suggested I go to the Traffic Department and claim it was not me driving the vehicle, but then who was driving the vehicle?

My major concern is that because this seems to be one of those immediately to court situations it might mean I will get a criminal record for simply speeding?

Does anyone have experience in this and what is the best thing to do?

Is it really your car?
 
Can you be a bit clearer? What exactly did the cop say to you? Is there a warrant out for your arrest?
 
Managed to get a proper look on Aarto's website and, yeah, unfortunately it is my car. Gave a call to JPSA and they recommended i get a criminal lawyer! :(

The cop just said there was a court case against me and said that he wanted to arrest me. They printed out a paper with all my unpaid fines (about four) plus these two extra that said court case.
 
admitted on a public forum you bribe and officer and now you want to complain about being caught for speeding? You should be prosecuted for bribery as well.
 
For a start, write a registered letter to them asking for copies of all the documentation supporting the case, ie summons, court record of the conviction, etc. Say clearly you believe the conviction is due to an administrative error and that you had never received spot fine, summons, etc. Ask for a reply within 14 days. Keep copies of all correspondence. When (if) they reply, see see a lawyer. If they don't reply, write again and attach copy of previous letter, copying clerk of the appropriate Mag court. If no joy, see a lawyer.

I doubt there is a warrant out for your arrest then. They almost certainly would have arrested you, bribe or no bribe, if there was a warrant out for your arrest. They cop probably just that to coerce you into bribing him.
 
These court fines are for when you go 40kph over the speed limit. You cant pay them, you have to go to traffic dept and speak to magistrate who will give you the fine amount, expect something like 5k per fine. You pay and you go, or you dont pay and you go and risk it again.

You pay, you end up with a criminal record.

30km/h over on urban roads and 40km/h over on highways is a criminal offence that carries a criminal charge of reckless and/or negligent driving or alternatively excessive speed, paying an admission of guilt fine will result in a criminal record.

So dont pay and take your chances?

I had one of these and didnt get a record, 2007 i think

No, you can refuse to pay the admission of guilt fine and ask for a trial. You then go to trial and ask to see the calibration certificate of the instrument, the qualifications of the operator, etc. and then hope they don't have any of the right documentation.

well, if you know what jails are like, don't you think you would want to obey the laws and not speed or pay BRIBES? it's no ones fault but your own if you pay a bribe and then get locked up with Big Bubba.
 
Could we please be helpful and not accusatory. I regret what happened (as said in the first post), but when one has a new baby at home all other priorities fall by the wayside. I need to know what to do now.

Right, because rape is a suitable punishment for speeding. :sick:

He could have knocked over an innocent pedestrian or even a child. 40km/h zones have that speed limit for a reason.

No, like i said i went to traffic dept in pta and they pointed me to a magistrate. I stated my case right there to him and he siad the fine is 5k. Told him i cant afford it and HIGHLY doubt i was doing 127kmh in pta cbd at 8am on a monday morning. He made the fine 2k, i paid and left. That was that, but i think its changed now. Heard a few times now that u get a record now if u simply pay these. My advice is go there and find out asap
