Court Case for Speeding

No, like i said i went to traffic dept in pta and they pointed me to a magistrate. I stated my case right there to him and he siad the fine is 5k. Told him i cant afford it and HIGHLY doubt i was doing 127kmh in pta cbd at 8am on a monday morning. He made the fine 2k, i paid and left. That was that, but i think its changed now. Heard a few times now that u get a record now if u simply pay these. My advice is go there and find out asap

The act was amended in 2010

Also if you are convicted or pay the admission of guilt you're driving license should also be suspended
 
Easy way to have avoided this:

1) Don't speed

2) Don't pay a bribe.

If you didn't speed, they wouldn't be able to show a warrant of arrest, meaning they can't arrest you...

I love when people complain about cops asking for bribes, but then pay it. Same, complain about cops sitting behind bushes with a camera, but then speed, effectively giving them a reason to do it / paying them. If no one speeds, they won't sit behind a speed camera behind a bush, its simple.
 
Have spoken to attorneys and some policemen buddies of mine.

It takes 30 years for the statute of limitations to kick on these type of criminal cases - and yes going to court for speeding is a criminal case.

Correspond with the court/authorities via mail and phone - don't pitch.
Some of my brother-in-law's drivers ended up with criminal records by paying the fines at court - be careful.

A summons must be delivered upon yourself in person (or anyone living at your house older than 18yrs).
Registered letters do not serve as summons - the law state the requirements regarding summons very very clearly.

Pay all the fines you can - use your online banking to see which fines can be paid if any.

Make sure there aren't any Orders of Execution out for any fines - it sounds ominous, but simply means they can make moves to get the money from you...

And lastly - You can not be arrested unless you commit a crime in front of a law enforcement officer OR a valid warrant is granted for your arrest. Period.

Cool, thanks for that info shinji! So in the mean time I need to avoid road blocks. I have checked on all the websites I can and paid anything outstanding.
It is now over a year and still no summons. I recently moved and I think I updated my address with the License Department, should I check this?

Also any idea on what kind of ccommunication I should engage the court / authorities with? As someone mentioned earlier... perhaps ask for all the documentation?

Ja, if people sped less, the cops would have to go do real work on moving violations for example.
 
I got a go directly to court fine. First reaction was no ways...not possible. Checked it out, and sure as Bob...there I was, my car. Checked the date and remembered it...was on a road I dont frequent running around with wedding arrangements. Was not a pleasant day, and a road I thought was a 100 zone was a 60 (3 lane road). This was in 2007.

So ja...dont speed like this, heard all the stories...was kukking myself. A few people in my situation previously said, go to the court first thing on a Friday morning and wait to speak to the prosecutor (was in Jhb, in a room near the courts - I never saw the inside of a court room). Friday first thing is best as its weekend around the corner, be the first cos at the end of the day, these guys have heard all excuses and chances are they will be in a fowl mood and give a hefty penalty, like R5k.

Think I was the third guy there...got called in, handed the fine. I was frickin shaking was so scared. He asked me so whats the story with this one. So told him honestly. Doing last minute preps for our wedding in 2 weeks, had lots to get through and thought it was a 100 zone cos it was a 3-4 lane road and I didnt recall seeing speed limit signs. Apologised a few thousand times etc. So he said how much can I afford...told him again, with wedding preps...not much at all. He asked if R700 was fine, I said yes and was soooo grateful. Told me I can pay it off in 2/3 months if I need to.

That was it...paid up and off I went.

The real kuk part, went on that road a week later...the speed limit sign was spray painted black, couldnt read it. If I had known that, I might even have been able to get out of it.

Ah well, lesson learnt though. No speed limit signs...I dont go more than 30km/h over 60.

Granted, not sure how the above scenario works today, if things have changed?

Did you receive a criminal record by admission of guilt(fine)?
 
keep in mind, with the "threat" of arrest, as a result of a warrant of arrest having being issued - for any reason:

arrest can only be effected on presentation of the ORIGINAL warrant, not an email copy, fax etc, ONLY THE ORIGINAL SIGNED warrant from the magistrate who issued it.
