CPA - New car purchase

Hi there

My friend recently purchased a new bakkie [01 July 2011]. So he's had it for 14 days. Yesterday on the highway, the right front wheel bearing seized, causing the front wheel to lock up [@ +- 90km/h].

In terms of the new CPA, can he tell the garage to replace his car, no questions asked?

I would guess that even without the CPA if something that serious happens within 14 days, you can crap them out with good results.

they've been trying to pretend that it aint that big a deal, but i told my friend to demand his money back, or ask for a new bakkie [it had less than 1000km on the clock]

Yes the cooling of period does apply so does the CPA and the old old law of latent defect. The new CPA does protect you. Take it back. Get a replacement. IF you dont get any help go to the Ombudsman or the RMA for help also speak to the bank

There is NO cooling off period in the case of a cash purchase, or where the finance contract was signed at a bank or on the dealer's floor...

If the OP's friend had bought it on his credit card (I know it's expensive.....) would that still count as a cash purchase?

I'm not sure, but in the end, he told GM [] that he is not interested in getting that bakkie back, and they are busy organising him a brand new one. so seems they are quite careful for the CPA, as a year ago you would have had to fight into court to get "a new one".

All's well that ends well, i suppose.
